In Voronezh, the case under Art. 282

As it became known on April 20, 2009, the criminal case under part 3 of article 30, part 1 of article 282 of the Criminal Code of the Russian Federation (attempted actions aimed at inciting social hatred or enmity), initiated in April 2007 in Voronezh, was closed due to lack of corpus delicti. Meanwhile, Viktor Potryvaev, who was a witness in the case, failed to obtain the return of the items confiscated during the search.

In addition to the newspaper "Friend of the People", in which the examination did not find signs of extremism, Potryvaev was confiscated more than 50 disks from his film library, a scarf with the inscription Communist Party and a flag with the image of Ernesto Che Guevara, as well as a personal computer, a seal of an individual entrepreneur and bank documentation.

Despite the fact that the case was closed, only a year and a half later, the computer was returned to Potryvaev, but without hard drives, and most of the other things were destroyed.

Potryvaev appealed to the Kominternovsky and Central Courts of Voronezh with a request to declare illegal the actions of law enforcement agencies to destroy his property, as well as illegal detention, night interrogations, an unreasonable search and an ineffective investigation of his complaints by the prosecutor's office of the Kominternovsky district.
