On September 24, 2009, the Magistrate's Court of District 416 of the city of Moscow sentenced
Nikolai Avdyushenkov, one of the participants in the action at the reception of the Russian Foreign Ministry, organized in July 2008 by supporters of national Bolshevism in Moscow, to one year of imprisonment on probation with a probationary period of two years.
Avdyushenkov was charged under Part 2 of Art. 282.2 of the Criminal Code of the Russian Federation (participation in the activities of an organization banned for extremism).
According to the lawyer Agranovsky, Avdyushenkov should have been acquitted, since he publicly stated that he is not a member of any organization now. At the trial, only evidence of the very fact of his participation in the action in the Ministry of Foreign Affairs, but not membership in the NBP, was presented.
