Recall that on August 14, 2009, the Ministry of Justice updated the federal list of extremist materials , adding paragraph 414 to it, which was a long list of certain materials, most of which could not be identified. The most notable in this list was the "flag with a cross", which was also recognized as extremist material and, thus, banned from production and mass distribution on the territory of the Russian Federation.
After that, the prosecutor went to court, pointing out that, based on the court order, it can be concluded that the "flag with a cross", mentioned with a semicolon, a poster depicting a shooting gunman, the Ku Klux Klans, is in itself extremist material. " .
The court came to the conclusion that the decision of December 8, 2008 made an error in listing the materials, and it should be corrected. The ruling of the court clarifies that "it is precisely the poster with the image of a shooting militant, and not the flag with a cross depicted in the same place" that is extremist .
At the end of November, an audit of the Federal List was carried out on the website of the Ministry of Justice. As a result, paragraph 414 was amended. Below we present the original version of paragraph 414 and its revised version . It is clearly seen that the ban itself has not become clearer - the materials are still almost impossible to identify. However, at least the formal ban on the use of the "flag with a cross" has now been lifted. [For the sake of readability, we break down both versions of paragraph 414 into positions that, in our opinion, are separate materials.
