MGER leaflets in law?

On November 26, 2009, the Central District Court of Khabarovsk refused to satisfy the claim of the Prosecutor of the Khabarovsk Territory for the recognition of a leaflet belonging to MGER ("Young Guard of United Russia") "Beware of the sect - the International Society for Krishna Consciousness" as extremist material.

The case was returned to the Central District Court of Khabarovsk after in September 2009 the Judicial Collegium for Civil Cases of the Khabarovsk Regional Court overturned the decision of the Central District Court of Khabarovsk of January 29 to recognize the MGER leaflet as extremist material, on the basis of which it was included in the Federal List extremist materials under No. 413.

It should be reminded that the leaflets were distributed by MGER activists in July 2008 during the festival of Indian culture. For their dissemination in November 2008, a criminal case was initiated under Part 1 of Article 282 of the Criminal Code of the Russian Federation (inciting hatred or enmity).

In early December 2009, the material was withdrawn from the Federal List (withdrawal occurred no later than December 6). At the same time, MGER activists say that the receipt of the court decision was expected no earlier than December 2. Thus, it is not entirely clear whether the court's decision had entered into force by the time the material was removed from the list.

At the same time, it is worth recalling that one of the arguments of the Ministry of Justice, which refused to remove Falun Dafa materials from the list, was the absence of the text of the court decision that came into force directly from the court.
