On December 14, 2009, the Moscow City Court dismissed a complaint against members of the Black Hawks group (a group of natives of the Caucasus who attacked people with Slavic appearance).
The cassation board upheld the verdict handed down by the Dorogomilovsky court on October 8, 2009, and the cassation appeal was not satisfied. The verdict came into force.
Recall that all the defendants were found guilty under paragraphs. "a", "b" part 2 of Art. 213 (hooliganism committed by a group of persons by prior agreement, with the use of weapons, motivated by national hatred). Dilgam Huseynov, who hit one of the students in the subway with a knife, was also convicted under paragraph "e" part 2 of Art. 111 of the Criminal Code of the Russian Federation (causing grievous bodily harm motivated by national hatred). Grant Arutyunov - according to paragraphs. "a", "b" part 2 of article 115 (intentional infliction of minor bodily harm motivated by ethnic hatred).
Huseynov was sentenced to 7 years in a penal colony. Arutyunov was sentenced to 6 years in a penal colony. Defendants Shahin Khudiyev, Chingiz Arifulin and Agaragim Sadikhov each received 5, 4.6 and 4 years of imprisonment, respectively, with serving their sentences in a penal colony. Defendant Rashad Mammadov, who had not reached the age of majority at the time of the crime, was sentenced to 5 years in a juvenile colony. One of the defendants in the case, Rasul Khalilov, was killed on September 3, 2009.
