Anti-extremist warning issued to Novorossiysk human rights activist

On December 10, 2009, the deputy head of the Internal Affairs Directorate for Novorossiysk, V.K. Bzik issued a warning about the inadmissibility of extremist activity to Vadim Karastelev, an expert of the Novorossiysk Committee for Human Rights ANO.

"On December 2, 2009, being in the lobby of the first floor of the administration of the hero city of Novorossiysk, instead of considering the existing problematic issues in a peaceful and calm atmosphere, you tried to go to the crowded hall of the administration where the hearings were held. At the same time, you jumped onto the fences, installed in the lobby of the building near the entrance, loudly shouted various remarks at the heads and employees of the city administration.As a result of their behavior, they could provoke the assembled citizens, who also wanted to take part in the hearings, to violate public order.Stop legitimate and repeated remarks to stop trying to get into the administration , You did not react, answered incorrectly, ignored the remarks of the administration duty officer and the police officer on duty , "the text of the warning says (spelling preserved).

We are talking about open hearings on the Bolshoi Utrish project, held in the city administration, to which, according to Karastelev, about 30 people were not allowed. After unsuccessful attempts to enter the closed hall, where open hearings were held, Karastelev was forcibly taken out of the city administration building. The human rights activist filed a complaint with the city prosecutor's office.

In our opinion, the warning was issued to Karastelev illegally for several reasons. First, according to the Federal Law "On counteracting extremist activity", warnings are issued to public organizations and the media, while warnings are issued to individuals. Secondly, nothing described in the police document falls under the definition of extremism. Provoking a possible violation of public order, even if it took place, is not extremism.

Vadim Karastelev intends to appeal the warning in court.
