On December 23, 2009, the ROAC published a response to the claim of the Department of Property and Land Relations of the Administration of the Vladimir Region on the release of the buildings of six rural churches of the ROAC in the Suzdal region. As a basis for its claims, the Department pointed out that the ROAC had no legal grounds for using the temple buildings. In his response, the representative of the ROAC in court cites arguments to refute the claim.
In particular, the representative of the ROAC points out that the disputed temples are in the legal possession of the ROAC in accordance with the Security Treaty, "which has not been terminated and is not disputed by the Claimant." In addition, it indicates the expiration of the limitation period for the claim.
In connection with the grounds indicated in the document, representatives of the ROAC declare that the claim of the Department is not subject to satisfaction.
It should be reminded that on October 28, 2009, the Arbitration Court began hearing this case.
