We publish a list of convictions handed down in 2009 under Art. 282.2 (participation and organization of activities of an organization recognized by the court as extremist), which, in our opinion, are unlawful.
We are not against Art. 282.2 as such. However, there are organizations whose very recognition as extremist/terrorist, in our opinion, is unlawful. In particular, these are the National Bolshevik Party (the grounds on which the NBP was banned were either initially a miscarriage of justice, or later turned out to be such, but the Moscow City Court refused to review the decision) and Hizb ut-Tahrir (the Supreme Court, recognizing this organization as terrorist, did not give any reasons at all; and we do not know such reasons). We do not claim that the activities of these organizations did not violate anti-extremist legislation, but until the decisions to ban them are reviewed, they should be considered unlawful. Accordingly, we also consider all sentences against members of these organizations, real or alleged, under Article 282.2 of the Criminal Code to be unlawful.
February 20, 2009, Moscow. The verdict in the case of the National Bolshevik Daria Isaeva. Found guilty under Part 2 of Art. 282.2 (participation in the activities of a prohibited organization) and part 2 of Art. 165 of the Criminal Code (causing property damage to the owner or other possessor of property by deception or abuse of trust in the absence of signs of theft).
March 6, 2009, Komsomolsk-on-Amur, Khabarovsk Territory. The verdict of the National Bolsheviks Dmitry and Alexander Voron. Found guilty under Part 2 of Art. 282.2 and Art. 319 of the Criminal Code (insulting a government official). In December 2009, the case was dismissed on cassation due to the expiration of the statute of limitations.
March 11, 2009, Moscow. The verdict of the National Bolshevik Dmitry Mants for participating in the action in the reception of the Ministry of Foreign Affairs. Found guilty under Part 2 of Art. 282.2 and part 1 of Art. 318 of the Criminal Code (use or threat of use of non-life-threatening violence against a government official in connection with the performance of his official duties).
May 12, 2009, Kazan. Conviction in the case of Rustem Safin's involvement in the Hizb ut-Tahrir organization. Sentenced to probation without additional sanctions.
September 2, 2009, Yoshkar-Ola. The verdict in the case of National Bolshevik Dmitry Rusov. Found guilty under Part 2 of Art. 282.2 of the Criminal Code of the Russian Federation.
May 25, 2009, Samara. The verdict in the case of the National Bolsheviks Roman Mishurov and Ilya Shunin. Found guilty under Part 2 of Art. 282.2 of the Criminal Code.
September 14, 2009, Yekaterinburg. Verdict in the case of National Bolshevik Alexei Nikiforov Found guilty under Art. 282.2 of the Criminal Code.
September 24, 2009, Moscow. The verdict in the case of National Bolshevik Nikolai Avdyushenkov for participating in an action in the reception room of the Ministry of Foreign Affairs. Found guilty under Part 2.Art. 282.2 of the Criminal Code.
September 30, 2009, Khabarovsk. The verdict of the National Bolsheviks Tatyana Kharlamova and Igor Shchuka. Found guilty under Part 1 of Art. 282 (incitement of national hatred), part 2 of Art. 282.2 and Art. 319 CC.
October 13, 2009, Moscow. The verdict of the National Bolshevik Kirill Unchuk for participating in the action in the reception area of the Ministry of Foreign Affairs. Found guilty under Art. 282.2 of the Criminal Code.
October 26, 2009, Moscow. The verdict of the National Bolshevik Dmitry Putenikhin for participating in the action in the reception room of the Ministry of Foreign Affairs. Found guilty under Art. 282.2 of the Criminal Code.
October 29, 2009, Kazan. The verdict in the case of the involvement of 12 people in the Hizb ut-Tahrir organization. The defendants were found guilty under Parts 1 and 2 of Art. 282.2 (organizations of an extremist community and participation in it), Part 1 of Art. 205.1 (promotion of terrorist activities and recruitment), Art. 278, 30 of the Criminal Code (attempt to violently seize power).
December 11, 2009, Chistopol, Republic of Tatarstan. Conviction in the case of Ilgiz Gizyatullin's involvement in the Hizb ut-Tahrir organization. Sentenced to 4 months in prison in a penal colony.
