Some materials of Scientologists are recognized as extremist

On March 26, 2010, the Surgut City Court of Khanty-Mansiysk Autonomous Okrug-Yugra recognized a number of texts by Ron Hubbard as extremist. The case was considered in a special order, representatives of Scientologists were not involved as defendants.

The Surgut transport prosecutor's office reports that the materials were sent for research to the religious council under the Governor of Khanty-Mansi Autonomous Okrug-Yugra, whose experts concluded that these texts "are unacceptable for distribution, as they undermine the traditional spiritual foundations of the life of citizens of the Russian Federation" .

In addition, during the judicial investigation, at the request of the prosecutor, a psycholinguistic examination was carried out, according to the conclusion of which, the materials justify violence as such and, in particular, against opponents of Scientology. According to the conclusion, the texts contain "both explicit and covert calls for social and religious discord, for propaganda of the exclusivity, superiority or inferiority of a person on the basis of his social and religious affiliation and attitude to religion, calls for obstructing the legitimate activities of state bodies, in particular , judicial and law enforcement, to commit crimes motivated by ideological and religious hatred" .

On April 22, 2010, the religious association "Church of Scientology of Moscow" and the copyright owner of Hubbard's works, Bridge Publication, which were not informed of the court decision and were not involved as defendants, filed a lawsuit against transport prosecutor. They demanded that the deadline for filing a cassation appeal be restored (they did not even know the date of the last trial), that they be provided with the text of the court decision and the opportunity to familiarize themselves with the case materials in order to draw up a reasoned appeal, as well as cancel the decision of the Surgut City Court and send the case for consideration by a different composition of judges. and oblige the court to involve all interested persons in the consideration of this case.

We do not know specific claims to the materials of Scientologists, since neither the court decision nor the texts of the examinations were published. The prosecutor's office's report does not even contain a complete list of prohibited texts. A cursory look at the courses of lectures mentioned above, one can say that the presence of signs of extremism in them is extremely doubtful. It is likely that, as in the case of Jehovah's Witnesses, the preaching of religion and the assertion of its exclusivity and truth (inherent in any religion) is passed off as incitement to hatred. Undermining the traditional spiritual foundations of Russian citizens - whatever that means - is not included in the legislative definition of extremist activity.

In June 2010, this court decision came into our possession. We note that there is nothing in the text of the decision itself that would explain the specific claims against this literature. The court completely relied on the opinion of experts, without delving into the essence to such an extent that one of them appears twice in the list of banned books (under paragraphs 14 and 25). Meanwhile, as we can judge, Hubbard's work is extremely incomprehensible to an unprepared reader. The court would not physically have time to make a decision in one session if it really tried to consider the case on the merits.
