On April 28, 2010, the Judicial Collegium for Criminal Cases of the Tula Regional Court satisfied the cassation appeal of Nina Zenkova, an activist of the local DPNI, the owner of the Tula-press store, which sells right-wing books.
We are talking about an attempt by an activist to challenge the fact of initiation of a criminal case against her. She applied to the Tula Central District Court with a corresponding application.
The reason for N. Zenkova's appeal to the court of first instance with a demand to recognize the initiation of a criminal case against her illegal was the fact that in the relevant decision, the investigator, among other things, identified as extremist literature the discovery in her store of several issues of the newspaper "Russkaya Pravda", which are extremist not recognized. (Earlier, N.Zenkova, on the same grounds, tried to challenge the legality of the search at her place).
On 24 February 2010 the Central District Court of Tula dismissed the complaint on the grounds that the applicant had applied outside of her jurisdiction and that she should have challenged the decision before the court at the location of the investigating authority.
However, the Tula-press store itself is registered in the Central District of the city. Therefore, the Tula Regional Court recognized the decision of the Central District Court as unlawful and decided to return the case to the court of first instance.
The investigation of the criminal case against N. Zenkova, according to the prosecutor's office of the Tula region, as of May 25, 2010, has not yet been completed.
