In Moscow, the initiation of a criminal case under Art. 282 of the Criminal Code of the Russian Federation

On May 17, 2010, it became known that Aslambek Ezhaev received a resolution to refuse to initiate a criminal case from the Investigative Committee at the Russian Prosecutor's Office for the city of Moscow under Part 1 of Art. 280 (calls to carry out extremist activities), part 1 of Art. 282 of the Criminal Code of the Russian Federation (an act aimed at inciting hatred or enmity) for lack of corpus delicti.

On April 14, 2010, the Investigation Department for the Kuntsevo District of the Investigative Directorate of the Investigative Committee at the Prosecutor's Office of the Russian Federation in Moscow received materials from an investigation into the discovery of a MAZ car with the books “Designation of the Righteous Caliphs” and “The Fortress of a Muslim.” The batch of books was detained and subsequently seized by law enforcement officers in Moscow.

During the pre-investigation investigation, it was established that on March 29, 2010, the publishing house, headed by A. Ezhaev, entered into an agreement with PIK Idel-Press for the production and supply of these two books. In addition, the conclusions of two experts were obtained, according to which the books “The Lives of the Righteous Caliphs” and “The Fortress of a Muslim” are not intended in their content to incite hatred or enmity on the grounds of gender, race, nationality, language, origin or attitude to religion.

Let us recall that in 2009 A. Ezhaev was fined in court in the amount of 50 thousand rubles for illegal use of a computer program. Initially, the case was initiated under Art. 282 of the Criminal Code of the Russian Federation.
