Financing the construction of an Orthodox church by the Ministry of Culture offends the religious feelings of Petrozavodsk residents

January 18, 2011 resident Petrozavodsk Maxim Efimov filed an application with the Supreme Court of the Republic of Karelia with a request to recognize void Law of the Republic of Kazakhstan " On the introduction of amendments to the law of the Republic of Karelia "On the budget of the Republic of Kazakhstan for 2010 and the planned period of 2011 and 2012” as contrary to federal legislation.

Clause 7.1. of the aforementioned law implies, among other things, the establishment of a “ subsidy for the construction of the Temple in the name of Great Martyr Panteleimon on Drevlyanka (Petrozavodsk) in the amount of 2,600,000 rubles. The main manager of funds is the Ministry of Culture and Public Relations of the Republic of Karelia ”.

Author statement indicates that the Legislative Assembly of the Republic of Kazakhstan, when adopting of the challenged Law, a violation of the constitutional principle secular state (Article 14 of the Constitution of the Russian Federation), as well as violated the law "On freedom of conscience", which allows the provision of financial assistance religious organizations in the restoration, maintenance and protection of buildings, but not in construction-related issues.

Maxim Efimov says: “ The existence of this norm in the system legislative acts of the Republic of Kazakhstan violates my legitimate interest in compliance with rule of law, undermines the principle of legal and democratic state, tramples on the foundations of the constitutional order, offends my religious feelings, moral convictions and civil position ."

On January 27, in the rulings issued by the judge of the Supreme Court T.V. Kudinova, Maxim Efimov was denied acceptance of his applications for court proceedings.

Recall that the question of legitimacy budget funding for the construction of temples was already raised in the summer and autumn of 2010 of the year.
