Sentence for posting materials on the VKontakte network

April 29 2011, the court of the Leninsky district of the city of Kemerovo passed a sentence under part 1 of article 280 of the Criminal Code of the Russian Federation (public calls for extremist activities) to 20-year-old Roman Kilin (Silin). He is sentenced to one year and six months probation for posting on the social network “In Vkontakte” xenophobic materials.

In 2009 R.Kilin put up the video "Russia 88 (Granny)" and the song "Glory to Rus'" of the group "Kolovrat" on his page on this network. In August 2010 FSB detective registered "VKontakte" under a fictitious account and added R.Kilin as a friend, gaining access to the contents of his account. All materials from there he transferred to investigation department of the FSB.

Protection petitioned for the termination of the criminal case “due to the lack of incriminated fragments on the federal list of extremist materials” and insisted on conducting certain examinations to prove that a network account belongs to a specific person. However, the court denied the defense petitions. The defendant's lawyer announced his intention to appeal the verdict.

Note that in the text songs "Glory to Rus'" by the group "Kolovrat" really contain calls for violent actions against the "blacks" in order to "cleanse Russia". Some songs of "Kolovrat" were recognized as extremist and included in the Federal List of Extremist materials, and they tried to group leader Denis Gerasimov , albeit unsuccessfully, convicted of racist propaganda in the Czech Republic in 2005.

Video "Russia 88 (Grandmother)" is a cutting of scenes from the film Pavel Bardin "Russia 88". The film itself is in no way xenophobic, the position of its authors is stated as unambiguously anti-fascist. However, cutting from the picture, uploaded by the convict, consists mainly of scenes promoting xenophobic violence.

We doubt the legitimacy of this verdict, because no one knows who the number of people, except for the detective, a record was available on the VKontakte network, it is not known how closed this group was, and if qualified under Article 280 of the Criminal Code of the Russian Federation, publicity is a fundamental factor.
