May 5, 2011 Ordzhonikidzevsky District Court Perm acquitted Roman Khoseev, who was accused under Article 20.29 of the Code of Administrative Offenses of the Russian Federation (production and distribution of extremist materials).
Recall that Khoseev was accused of that in April 2005 he published on the Teron.ru forum several quotes from Hitler's "Mein Kampf" by linking to the publication of the book on the web. The quotes were given in the context of a conversation about US actions in Iraq: Khoseev compared Bush with Hitler and he needed quotes to reinforce his thoughts. 14 April 2011, the world court of the Ordzhonikidzevsky district of Perm decided to stop proceedings, but on April 19, the prosecutor's office appealed this decision.
Hearings in the case took place in Ordzhonikidzevsky District Court May 4, 2011. Prosecutor's office insisted on three counts of the offense: Khoseev quoted Hitler after the adoption in 2002 of a law on combating extremist activities, according to to whom the works of leaders National Socialist German Workers' Party are considered extremist materials and are prohibited for publication and mass distribution; after the adoption in 2007 of Article 20.29 of the Code of Administrative Offenses of the Russian Federation, introducing liability for distribution of extremist materials, he did not remove the quote; publication on forum was preserved even after the introduction of the book "Mein Kampf" in the Federal list of extremist materials in 2010. For his part, Khoseev argued that he used a phrase from "Mein Kampf" in the context of a discussion about the war in Iraq, the book itself was banned only five years later in 2010, and the law cannot be retroactive. The court ruled in favor of Khoseev, but the prosecutor's office said it would seek a new trial.
