21 June 2011, the Perm Regional Court decided to terminate the proceedings on the case of Roman Khoseev. This became known on June 23 from a message on the website of the court. Thus, the cassation appeal of the prosecutor's office against the acquittal, handed down to Khoseev by the Ordzhonikidzevsky District Court was rejected.
Recall that Khoseev was accused under Art. 20.29 Administrative Code of the Russian Federation (production and dissemination of extremist materials) is that in April 2005 published several quotes from "Mein Kampf" on the Teron.ru forum Hitler by placing links to the publication of the book on the web. The quotations were given in in the context of a conversation about US actions in Iraq: Khoseev compared Bush with Hitler and he needed quotes to reinforce his thought. May 5, 2011 The Ordzhonikidzevsky District Court decided to close the case, but the prosecutor's office appealed this decision.
At the trial of the hosts argued that he used the phrase from "Mein Kampf" in the context discussions about the war in Iraq, the book itself was banned only five years later in 2010 year, and the law cannot be retroactive. We believe that the initiation of a case against Roman Khoseev was unlawful, for reasons unrelated to the time the quotes were posted online. From our point view, publishing links to prohibited materials, as well as citing such materials should not be considered as their distribution. Sources
