On July 20, 2011 it became known that the Investigative Department of the Investigative Committee of the Russian Federation for the Amur Region refused the pastor of the Church "New generation" of Blagoveshchensk to Mikhail Darbinyan in initiation of two criminal cases under Art. 282 of the Criminal Code of the Russian Federation (Excitation hatred or enmity, as well as the humiliation of human dignity).
The first statement of M. Darbinyan concerned the statements, posted on the Portamur.ru website, which were directed against members New Generation Churches. Site user Viktor Rogachev wrote: “ The whole new generation of schmyrs and bastards <…>, you are a sect with American overtones. I have only one suggestion for this occasion - to temporarily lift the moratorium on death penalty, condemn and destroy the entire leadership of the sect, all sectarians who had nothing to do with the spread of the sect, placed in rehabilitation centers (psychiatric hospital) ". User Spasm used no less harsh language against members of the community.
According to the applicant, such statements frankly humiliate the human dignity of members of the Church.
M. Darbinyan's second statement concerned a letter from a member Public Chamber of the Amur Region Irina Militskaya, in February 2011 sent addressed to the Secretary of the Public Chamber of the Amur Region N.L. Gryzlova. In a letter said: " I consider it necessary to bring to your knowledge that the Commission includes V.N. Yakushchenko, [who] maintains close contacts with the Church "New generation". <...> Today in Russia, an irrefutable fact is the belonging of this Church to totalitarian sects. Because the support for neo-Pentecostalism is contrary to the National Security Concept RF, then this will hinder the interaction of members and participants in the activity Commission and the Public Chamber as a whole .
The pastor's statement emphasizes that " the author [of the letter] actually claims that even communication with a group of persons who are parishioners of the New Generation Church, in itself already has a vicious character and has a negative impact on the implementation of the Public Chamber of the Amur areas of their functions .
The grounds for refusal to initiate criminal proceedings were examination results. According to professor Center for Linguistics BSPU E.V. Bykova, the text posted on the site "Portamur.ru" " contains roughly colloquial, abusive lexemes, however, all of them are expressed unaddressed (no a specific addressee) and are not an insult in an indecent form , "but letter to I. Militskaya, written " in neutral literary style ", " not contains rude or obscene words and expressions .
Church "New Generation" in Blagoveshchensk intends to appeal against the decisions of the Investigation Department of the Investigation Department Investigative Committee of the Russian Federation for the Amur Region in court.
