Assistant prosecutor Polina Trombacheva, a long -legged blonde, former Miss Student MGUA, all seven hours of the last hearing in the Presnensky court about falsifications in PEC No. 81 did in silence. In this area, as on dozens of others, the final protocol on the Cyc website was very dispersed in favor of United Russia with protocols that were issued to observers immediately after the vote count. The assistant prosecutor was bored, painted butterflies and flowers, fiddled with a mobile phone and first ran out of the hall during 15-minute breaks, confidently balancing on high studs. The only question that she asked was addressed to the defendant of Claudia Titova, social worker and former chairman of the PEC No. 81: whether she agrees with one of the statements of the plaintiffs that in the final protocol a signature of one of the members of the commission was forged. Titova, a middle -aged woman with a puffy face, each time, answering questions, nervously looked back at her lawyer, who twisted the procedure in her hands. Titova’s words “no, the real signature” granted Trombachev, and she read out the speech: the accusation is critical of the plaintiff’s arguments and believes that it is necessary to refuse to satisfy all the requirements. The plaintiff’s lawyer Andrei Strict, who was hoping for a favorable outcome all this time, only shook his head during his speech: he realized that the judge would approve the decision of the prosecutor.
Clean elections?
“If you have any reason to go to court - apply and achieve the relevant results,” President Dmitry Medvedev said at a meeting with students of the journalism faculty of Moscow State University on January 25, answering the question of fake falsifications. The president called the elections that had passed the elections “the purest elections in our history”, although he noticed that there would be more elections and “there will still be violations, there will be attempts to falsify. But we must do everything so that this is under the control of society. ” The same mantra was repeated after the elections, Prime Minister Vladimir Putin, who also promised that the courts "would act energetically and objectively."
According to official figures, 1686 appeals were received in the CEC, of which only 195, 4406 complaints were sent to regional election commissions, 789 were satisfied of them. The courts throughout the country considered only two thousand cases, and only two of them ended in the abolition of election results.
Natalya Ushlyakova, a teacher and owner of his own travel agency, was a member of the commission No. 81 with a decisive vote from the Communist Party. She and her lawyer Andrei strict counted a dozen violations that the court did not recognize. Here are some of the list: the chairman of the commission Claudius Titov left part of the ballots in its safe; A representative of the district council appeared on the site, which gave instructions to the Chairman of the PEC; Ushlyakova and the observer from Yabloko were removed from the site by police; When calculating the ballots, the loss of 301 ballots was found. To top it all in the night, the Chairman of the PEC and her assistant, without compiling the final protocol, fled with all the documents through the window, and the protocol with the changed data was filed in the TIC only in the evening of the next day. The result: “United Russia” added 322 votes, took 3 from the “right business”, 25 from Yabloko, added 1 “patriots of Russia”, and also doubled the result of the LDPR and “Just Russia”. One of the main evidence of falsification was the fact that in the last two hours of work of the site (from 6 to 8 pm), the turnout, judging by the protocol, jumped 44.49%. The plaintiff and her lawyer especially focused on the fact that 649 people were physically impossible to accept in two hours: each of the four members of the commission, recorded and work with voters, would have had 162 voters, that is, 44 seconds per person. “They had to check each according to the list, write passport data in the book, let them sign and issue a ballot. In 44 seconds! This is unthinkable and goes beyond common sense, ”says Andrei Strogeniy.
The judge studied all the evidence, even accepted for consideration a whole pile of videos made on the phone by an observer from Yabloko, but they did not affect its decision.
Search for justice
“If there were at least one successful result in court, we would immediately replicate such information,” says Arkady Lyubarev, leading expert at the Voice association. - And still, I do not think that going to court is a meaningless occupation. The court is good in that this is an open procedure, you can participate in it, ask questions, show a detailed picture, how falsifications were made. But it is very difficult to hope for a successful resolution of affairs in our conditions. ” "
At night, the chairman of the PEC and her assistant, without compiling the final protocol, ran away with all the documents through the window
“At first I filed a lawsuit in the Simonovsky court, but the case was refused there, saying that my rights were not violated, but I could not advocate the rights of an unlimited group of persons,” says Dmitry Surnin, the editor -in -chief of the new district newspaper. The election compared the protocol and the data of the CEC and found that “United Russia” was thrown at the last moment 391 votes *** “How are we ...”, The New Times No. 42 of December 12, 2011, after refusal, Surnin appealed to the Yabloko party, filed with their lawyers, which transferred him to Simonovsky, where in the consideration of the case again They refused.
Sergey Malikov, Yabloko lawyer, told The New Times that the Moscow Party Branch 351 has a complaint “in work” - of which 92 cases of observers are removed, 90 stuffing, 53 protocols with discrepancies with the final result. So far, only 50 claims were filed to the court, and for all 50, a refusal was received. “We have repeatedly faced an amazing fact: representatives of the election commission in court stated that the protocol, which the plaintiffs refer to is not real, but“ training, ”says Malikov. -That is, according to them, the situation looks like this: the observer came, interfered with his feet, demanded a copy of the protocol, and they were not yet ready to give it out, after which the observer grabbed some working document from the table and ran away. And these working documents are just copies, with seals, prints, signatures of the chairmen of the commission. Made for training: they, they say, trained to draw up documents correctly. ”
The car driver and businessman Boris Zimin, the chairman of the Board of Trustees of the Dynasty Foundation and the son of the founder of Beeline Dmitry Zimin, went to the election by a volunteer observer from the “observer citizen”. At the polling station No. 411 of the district, Sokol Zimin tried to stop an undisguised stuffing about 600 ballots and almost fought with the chairman of the commission. Zimin appealed to the Savelovsky court to achieve the cancellation of elections on this site. Neither the representative of the Moscow City Electoral Commission, nor the representative of the election commission No. 411, as the commission is disbanded 10 days after the end of the elections, came to the meeting. The judge decided to close the case, because, as stated in the court ruling, acts that do not affect the rights, freedoms and legitimate interests of the applicant are disputed in the statement. Zimin does not intend to stop the same, like Andrei Strictly, is going to reach the Strasbourg Court.
Ilya Azar, correspondent Lenta.ru, who participated in the loud disclosure of the “carousel” scheme, told The New Times that the case hung somewhere in the process of pre-investigation checks and references from one instance to another-from the ATS to the prosecutor's office and back to the prosecutor's office. “Now for another month or two they can decide whether to initiate a criminal case, maybe they will go back to the police department for additional materials, and if he someday, the case will not come soon.”
Presidential court *
Alexei Zaitsev, student of the journalism department of Moscow State University, on December 4, was an observer in section No. 1181 in North Izmailovo - in his native school. Zaitsev had no questions to the counting of votes, he took the protocol and went home. In the morning, comparing the official results with his protocol, I saw that United Russia added 350 votes. Zaitsev on the social network contacted the law enforcement officer of the Moscow State University, and he helped to draw up a lawsuit. But the guys did not submit it, because they realized that in Moscow there was not a single case when the court recognized such claims fair. After the visit of President Dmitry Medvedev to the journalism department on January 25, Alexei changed his mind. And on February 1, he filed a lawsuit against the Izmailovsky court. “I thought that since everyone was asking for something, a dress there, get a job, help in life, then I will also ask: to arrange an impartial court. He told me to hand him the documents, and he would get acquainted with them. ” It was to the question of Zaitsev that the president said that everyone who dissatisfied needs to go to court.
The next morning, Alexei Zaitsev woke a call from the control department of the presidential administration. He was invited to Old Square and asked to constantly report any progress in the case. The building of the Zaitsev administration was struck: “It seems either to the old clinic, or to the sanatorium - there was no repair for a long time, the old Soviet numbers hang on the doors, there are Moscow radio receivers. In general, they enjoy their vintage. ” Zaitsev filed a lawsuit, handed over the administration to employees. “It is very interesting to see how the matter will end: on the one hand, there is clearly a political decision not to review the results of the elections in Moscow. On the other hand, nevertheless, the president took control of, ”concludes Zaitsev.
According to the expert Arkady Lubarev, even if decisions are not made in favor of dissatisfied voters, you need to continue to go to court: “You can’t give falsifiers of a calm life, you need to call them to court, let them be nervous, let them feel uncomfortable. Next time, maybe they will think before fake results. Yes, people do not believe in justice and perfectly understand how the courts end. Yes, even rare victories do not change the picture on a country scale. But still, it is necessary to continue to file claims and achieve justice. ” Let the election results in the region with at least two or three sections-this, Lyubarev is sure, will affect not only public opinion, but also the behavior of power in the future. Or maybe even lead to the redistribution of mandates. But while the courts hold the defense and do not recognize the obvious facts.
