An anti-fascist in Ivanovo received a prison term for a fight with a skinhead
On March 5, 2012, it became known about the criminal case under paragraph "b" part 2 Art. 115 (intentional infliction of minor bodily harm motivated by hatred and enmity against a social group) and paragraphs. "a", "b" part 1 of Art. 213 of the Criminal Code of the Russian Federation (hooliganism with the use of objects used as weapons, motivated by hatred and enmity against a social group) initiated on the fact attacks by an antifa activist from Ivanov, I.A. Venin, on a skinhead.
On September 18, 2011, I.A. Venin, who, according to the prosecutor’s office, is a representative of a “ social group of anti-fascists ”, beat with brass knuckles a man he met in the city center a minor representative of the " social group of skinheads ", and when he tried to run, he shot after him from a rocket launcher.
On February 29, 2012, the defendant was sentenced to 1 year and 7 months in prison with serving a sentence in a colony-settlement.
On May 22, 2012, it became known that the lawyer I. Venin appealed against the verdict (in including trying to challenge the motive of hatred against a social group). Judicial the Collegium for Criminal Cases of the Ivanovo Regional Court left the complaint without satisfaction. The verdict came into force.
From our point of view, the verdict is unlawful in part of paragraph "b" of Part 1 of Art. 213 of the Criminal Code of the Russian Federation: the motive of hatred or hostility in this case should not be taken into account, since skinheads are not a vulnerable social group that needs protection provided by anti-extremist legislation. In addition, we advocate the exclusion of the vague concept of "social group" from the composition of anti-extremist articles.
