The sentences of 3 out of 5 people convicted in the case of riots on Manezhnaya Square were reduced by several months.

On March 29, 2012, the Moscow City Court considered a complaint against the verdict of the Tverskoy District Court dated October 28, 2011 against 5 defendants in the case of riots on Manezhnaya Square .

Recall that there were three members of the Other Party in the dock Russia "- 23-year-old citizen of Belarus Igor Berezyuk , citizens of Russia - 22-year-old Kirill Unchuk, 34-year-old Ruslan Khubaev . (Recall that the party was proclaimed by E. Limonov on July 10, 2010, its asset is the former asset of the NBP). Moreover, the verdict was 31-year-old Leonid Panin and 27-year-old Alexander Kozevin . All the convicts had previous convictions.

All the defendants were charged with incitement to riots and violence (Part 3, Article 212 of the Criminal Code of the Russian Federation) and the use of violence against a representative of the authorities (Part 2, Article 318 of the Criminal Code of the Russian Federation). Initially, they were also accused of hooliganism motivated by hatred (part 2 of article 213 of the Criminal Code of the Russian Federation), but later this charge was dropped. I. Berezyuk was also accused of inciting ethnic hatred (part 1 of article 282 of the Criminal Code of the Russian Federation) and involving a minor in a crime motivated by hatred (part 4 of article 150 of the Criminal Code of the Russian Federation).

The defendants' lawyers appealed the verdict, insisting that the defendants could not have been the organizers of the riots on Manezhnaya Square, because the unrest was spontaneous, unorganized.

The Moscow City Court did not accept the arguments of the defense, but changed the verdict in connection with the liberalization of legislation and mitigation of punishment under Part 3 of Art. 212 of the Criminal Code of the Russian Federation (Organization of mass riots) - earlier, in this paragraph, among others, punishment in the form of arrest from 2 to 4 months was provided, but this type of punishment was excluded from the new version of the law.

As a result, the terms of 3 out of 5 convicts were reduced by several months:

I. Berezyuk from 5 years and 6 months in a strict regime colony to 5 years and 3 months;

R. Khubaev from 4 years in a strict regime colony to 3 years and 9 months;

A. Kozevin from 2 years and 6 months to 2 years and 4 months.
