Sanctions against library employees. Part 3

Since the emergence of the Federal List of Extremist Literature instances of sanctions against library staff have become regular. Even in cases where claims against librarians formally substantiated by anti-extremist legislation, we often do not we consider them legitimate, since this legislation is in contradictions with the law "On librarianship". See here for more details .

In addition, anti-extremist sanctions against libraries for their lack of a list of extremist materials, in our opinion, look like an imitation of activity designed to artificially inflate relevant statistics.

We have combined these cases into a single list, the first part of which covers the period from July 2008 to June 2011, and the second part - from July 2011 to June 2012. The list continues in front of you.

On December 19, 2014, it became known that the prosecutor's office of the Volosovsky district of the Leningrad region brought 14 protests about bringing the Regulations on Libraries operating in the libraries of the district into line with the law. The sanctions are due to the fact that these Regulations do not contain a direct indication of the prohibition of the distribution and storage of prohibited, including extremist, literature.
On December 15, 2014, the prosecutor's office of the Republic of Altai reported that the prosecutor's office of the Ulagansky district issued reprimands to four employees of local rural libraries. The reason was, in particular, the fact that the libraries did not have a fresh version of the Federal List of Extremist Materials and the collections and new receipts were not checked with it often enough.
On November 28, 2014, it became known about the measures taken by the prosecutor's office of the Kuytunsky district of the Irkutsk region in relation to the heads of 15 educational institutions of the district. The reason for the response was that in school, etc. Libraries did not have copies of the Federal List of Extremist Materials and no reconciliation of library collections and incoming literature with the List was carried out. The prosecutor's office reports 9 submissions to eliminate violations of the law and 6 lawsuits to the Kuitunsky District Court demanding that copies of the Federal List of Extremist Materials be available and that funds be verified.
On November 27, 2014, the prosecutor's office of the Turochaksky district of the Republic of Altai reported on the submission made to the director of the Tondoshenskaya school due to the fact that the school library did not have an updated version of the Federal List of Extremist Materials. On December 24, 2014, it became known that the submission was satisfied, the responsible person was subjected to disciplinary action.
On November 26, 2014, it became known about the response measures (without specification) taken by the units of the prosecutor's office of the Republic of Tyva in relation to the heads of rural and school libraries of the Pii-Khemsky, Chaa-Kholsky and Erzinsky districts of the Republic of Tyva. The reason for the response was that these libraries did not check the funds against the Federal List of Extremist Materials.
On November 26, 2014, information appeared about the submission made by the Butyrskaya Interdistrict Prosecutor's Office of Moscow to the director of construction technical school No. 12 in the Lianozovo district. The reason for the sanction was, among other things, the fact that the technical school library did not have a copy of the Federal List of Extremist Materials.
On November 20, 2014, it became known about the submission that the prosecutor's office of the Lev-Tolstovsky district of the Lipetsk region made to the director of the Lev-Tolstovsky inter-settlement library. The sanction, among other things, was caused by the fact that the library did not have an up-to-date version of the Federal List of Extremist Materials.
On November 18, 2014, it became known about the submission made by the prosecutor's office of the Turochaksky district of the Republic of Altai based on the results of an audit of the activities of the inter-settlement library of the House of Creativity and Leisure named after. V.M. Bashunov. The reason for the sanction was, in particular, that the library did not have an updated copy of the Federal List of Extremist Materials.
On November 7, 2014, the prosecutor's office of the Republic of Altai reported on the submissions made by the prosecutor's office of the Shebalinsky district of the Republic of Altai to the directors of the Kaspinskaya and Malo-Cherginskaya schools of the Shebalinsky district, and the submission made by the prosecutor's office of the Turochaksky district to the director of the Turochaksky school of the Turochaksky district of the Altai Republic. The reason for these sanctions was that school libraries did not have an updated version of the Federal List of Extremist Materials.
On November 7, 2014, the prosecutor's office of the Mezhdurechensky district of the Vologda region announced the presentation to the director of the Shuya school of the Mezhdurechensky district. The reason for the sanction was, in particular, that the school library did not have a copy of the Federal List of Extremist Materials, and there were no reconciliations of funds and incoming literature with it.
On November 5, 2014, the Prosecutor's Office of the Novosibirsk Region announced that on September 24, 2014, it submitted a motion to eliminate violations of the law on countering extremism to the director of the State Public Scientific and Technical Library of the Siberian Branch of the Russian Academy of Sciences (SPSL SB RAS). As a result, three employees were brought to disciplinary responsibility. The reason was that several forbidden books were found in the library: the book "Mystery of Shambhala" from the series "Wisdom of Shambhala" by an unidentified author under the pseudonym "Svetozar" and the book by E. Drumont "Jewish France" under the general editorship of V. Mironov.
On October 27, 2014, the prosecutor's office of the Magadan region reported that the prosecutor's office of the Srednekansky district had submitted a proposal to eliminate violations of the law to the director of the school in the village of Seichman. The reason was, in particular, that the school library did not have an up-to-date version of the Federal List of Extremist Materials and no reconciliation of library funds and new acquisitions with it was carried out. The submission is under review.
On October 21, 2014, the Prosecutor's Office of the Menzelinsky District of the Republic of Tatarstan announced a proposal to eliminate violations submitted to the head of the education department of the Executive Committee of the Menzelinsky District of the Republic of Tatarstan. The sanction was caused by the fact that there were no copies of the Federal List of Extremist Materials in the libraries of 20 educational institutions of the district, and no reconciliation of the fund with the List was carried out.
On October 16, 2014, it became known about six lawsuits filed by the prosecutor's office of the Nyurba district of the Republic of Sakha (Yakutia), in which it was required to impose on schools the obligation to conduct regular reconciliations of school library funds and incoming literature with the Federal List of Extremist Materials. The court granted the claims. The reason for the lawsuits was that the libraries of six schools in the district did not conduct regular checks of funds and incoming literature with the Federal List.
On October 14, 2014, it became known about the submission made by the prosecutor's office of the Smirnykhovsky district of the Sakhalin region to the director of the school in the village of Pobedino, Smirnykhovsky district. The reason for the presentation was that the school library did not have a copy of the Federal List of Extremist Materials, in connection with which no reconciliation of funds and incoming literature was carried out with it.
On October 6, 2014, the Prosecutor’s Office of the Ivanovo Region reported that the Prosecutor’s Office of the Palekh District filed a lawsuit against the leadership of the Maidakovskaya Secondary School with the aim of obliging them to organize a reconciliation of library collections and incoming literature with the Federal List of Extremist Materials, but the proceedings were terminated due to with the defendant's voluntary compliance with the requirements of the prosecutor.
On September 30, 2014, the prosecutor's office of the Republic of Sakha (Yakutia) reported that the prosecutor's office of the city of Udachny made two submissions to eliminate violations of the law against the Nadezhda Center for Additional Education for Children and Vocational School No. 30 and brought two statements of claim to the court due to the fact that in the libraries of the institutions, no reconciliation of funds and new acquisitions with the Federal List of Extremist Materials was carried out.
On September 30, 2014, the prosecutor's office of the Kaluga region reported that the prosecutor's office of the Sukhinichsky district brought protests to six educational institutions, following the consideration of which local acts regulating the operation of school libraries were supplemented with a provision on reconciliation of funds and incoming literature with the Federal List of Extremist Materials.
On September 23, 2014, it became known that the Sokolsk Interdistrict Prosecutor's Office of the Vologda Oblast made a submission to the director of the Vologda Cadet Boarding School. The reason for the sanction, in particular, was the fact that the library of the boarding school does not have the Federal List of Extremist Materials, and there are no checks with it of funds and incoming literature.
On September 18, 2014, the prosecutor's office of Karachay-Cherkessia reported that the prosecutor's office of the Urup district had made submissions to eliminate violations of the law against the directors of secondary school No. 2 in the village of Pregradnaya and the secondary school in the village of Kyzyl-Urup. The reason was that the Federal List of Extremist Materials was not updated promptly enough in school libraries. Submissions are under consideration.
On September 16, 2014, it became known about the submission made by the prosecutor's office of the Pustoshkinsky district of the Pskov region to the leadership of the school in the village of Pustoshka. The reason for the sanction was that the school library did not conduct reconciliation of funds with the Federal List of Extremist Materials.
On September 15, 2014, the prosecutor's office of the Republic of Altai reported that the prosecutor's office of the Turochaksky district had submitted a proposal to eliminate violations of the law to the administration of the Kebezenskaya secondary school. The reason was that the school library had the Federal List of Extremist Materials in the 2013 version, and there was no reconciliation of funds and new receipts with the last 470 items on the list.
On September 3, 2014, the prosecutor's office of the Altai Territory reported that the prosecutor's office of the city of Rubtsovsk made 8 submissions to the heads of educational institutions. The reason was, in particular, that there was no Federal List of Extremist Materials in the libraries of the institutions and, accordingly, no reconciliation of funds and incoming materials with it was carried out.
On August 28, 2014, the prosecutor's office of the Tambov region reported that the prosecutor's office of Michurinsk had made submissions to eliminate violations of the law against the leaders of the Michurin boarding school and the Industrial and Technological College. The reason was the fact that for a long time in the libraries of institutions there was no reconciliation of funds and new acquisitions with the Federal List of Extremist Materials.
On August 26, 2014, the Ivdel prosecutor's office in the Sverdlovsk region reported that directors of a number of city schools had been warned. The reason for some of the sanctions was the lack of copies of the Federal List of Extremist Materials in school libraries. The number of schools is not reported.
On August 11, 2014, it became known about the submission made to the leadership of the House of Creativity and Leisure of the Turochaksky District of the Altai Republic by the Prosecutor's Office of the Turochaksky District of the Altai Republic. The reason for the sanction was, in particular, the lack of an updated version of the Federal List of Extremist Materials in the library of the House of Creativity.
On August 8, 2014, the prosecutor's office of the Kaluga region reported that the prosecutor's office of the Duminichsky district had made 8 submissions to the heads of the district's educational institutions. The reason was that the school libraries did not regularly check the funds and new acquisitions with the Federal List of Extremist Materials.
On August 4, 2014, the Prosecutor's Office of the Moscow Region reported that the Khimki City Prosecutor's Office filed protests against regulations on school libraries in the Khimki Urban District, none of which provide for verification of incoming literature against the Federal List of Extremist Materials. The protests of the prosecutor's office were considered and satisfied, the necessary changes were made to the regulations on school libraries, "a method for identifying extremist literature was provided and the procedure for conducting appropriate reconciliations was determined."
On July 25, 2014, the prosecutor's office of the Maksatikha district of the Tver region reported on the submissions made to the directors of the Maksatikha school No. 1, Dubischenskaya and Seletskaya schools. The reason for the sanctions was the lack of an up-to-date version of the Federal List of Extremist Materials in school libraries.
On July 18, 2014, information appeared that the prosecutor's office of the Kalarsky district of the Trans-Baikal Territory made submissions to the directors of two libraries. The reason for the sanctions was that "extremist materials" were available to readers. It is not clear from the prosecutor's report what is meant: books recognized as extremist, or the ability to access certain prohibited sites from library computers. Similar violations are also reported in other areas of the Trans-Baikal Territory (details unknown).
On July 17, 2014, it became known about the submission made by the prosecutor's office of Gorno-Altaisk to the director of the Gorno-Altai College of Construction Industry and Service. The reason for the sanction was, in particular, the fact that the library of the technical school did not check the fund and incoming literature with the Federal List of Extremist Materials.
On July 10, 2014, it became known that the prosecutor's office of the Izmalkovsky district of the Lipetsk region revealed a violation in the work of the Pyatnitsky settlement center of culture and leisure, which consisted in the fact that the act regulating the duties of a librarian in this center did not contain a requirement to coordinate the library fund with the Federal List of Extremist Materials. The violation is reported to have been fixed. The nature of the sanction is not specified.
On July 7, 2014, the prosecutor's office of the Takhtamukaysky district of the Republic of Adygea announced that it had issued warnings about the inadmissibility of violating the law on countering extremist activity to the directors of 21 schools in the Takhtamukaysky district and the heads of 4 regional libraries. The reason for the sanctions was that libraries, both district and school, do not have an updated version of the Federal List of Extremist Materials, and reconciliation of incoming literature with the List is not conducted.
On June 30, 2014, the prosecutor's office of the Komsomolsk district of the Ivanovo region reported on the submissions made to the head of the education department of the Komsomolsk municipal district and the directors of Komsomolsk schools No. 1 and No. in literature libraries. Submissions were also made to the principals of Pistsovskaya, Oktyabrskaya, Nikolskaya, Ivankovskaya, Sedelnitskaya, and Markovskaya schools due to the fact that school libraries did not have updated versions of the Federal List of Extremist Materials.
On June 27, 2014, the prosecutor's office of the Uvelsky district of the Chelyabinsk region announced that it had submitted a proposal to eliminate the legislation on countering extremism to the directors of the Kamenskaya secondary school and the Mordvinovskaya secondary school. The reason was that there was no Federal List of Extremist Materials in the school libraries and there was no reconciliation of funds with it. It is reported that the submissions were considered and satisfied, the violations were eliminated, two officials were brought to disciplinary responsibility.
On June 26, the prosecutor's office of the Tambov region reported that the prosecutor's office of Kotovsk had submitted proposals to eliminate violations of the law and bring the perpetrators to disciplinary responsibility against the heads of three educational institutions in the city. The reason was that school librarians did not have up-to-date information about the state of the Federal List of Extremist Materials and did not check funds and new receipts with it.
On June 25, 2014, it became known about the submissions that the prosecutor's office of the Pribaikalsky district of the Republic of Buryatia submitted to the directors of the Pribaikalskaya inter-settlement pulp and paper mill, the Ilyinsky cultural and information center and the Tataurovsky cultural and information center "Horizon". The reason for the sanctions was, in particular, the fact that the libraries that are part of these institutions did not check the funds and incoming literature with the Federal List of Extremist Materials, and there were no updated versions of the List.
On June 23, 2014, the Prosecutor's Office of the Pavlovsky District of the Krasnodar Territory announced the submissions made by the head of seven rural settlements in the district. The reason for the sanctions was the lack of an updated version of the Federal List of Extremist Materials in 13 district libraries.
On June 20, 2014, the prosecutor's office of Kabardino-Balkaria reported that the prosecutor's office of the Maisky district of the republic had filed protests demanding changes to the regulations on the libraries of the district's educational institutions, which do not stipulate a ban on the distribution of extremist literature and the need to reconcile library collections and new acquisitions with the Federal List extremist materials.
On June 20, 2014, the Prosecutor's Office of the Central Administrative District of Krasnodar announced that it had made submissions to eliminate violations of the legislation on countering extremism against the heads of ten educational institutions of the district (MBOU secondary school No. 34, 22, 32, 43, 35, 30.12, MBOU VSOSH No. 6, GBS (K) OU No. 91.21). The reason was that the libraries of the institutions did not check the fund and incoming literature with the Federal List of Extremist Materials.
On June 20, 2014, the prosecutor's office of the Sverdlovsk region reported that the Tavda city prosecutor's office had filed a motion to eliminate violations of the law on countering extremism against the director of a secondary school in the village of Gorodishche. The reason was that the school library did not check the fund and incoming literature with the federal list of extremist materials.
On June 19, 2014, the prosecutor's office of the Industrial District of Samara announced the submission made to the director of school No. 120, Vladimir Larionov. The reason for the sanction was that the Regulations on the school library did not contain a clause prohibiting the distribution of extremist literature, and the procedure for checking the library fund and incoming literature with the Federal List of Extremist Materials was not established. Since the prosecutor's office was not informed about the time and place of consideration of the submission, no one was held liable as a result, and also because the director did not comply with the requirements of the prosecutor's office set out in the submission on the elimination of violations of the law on narcotic drugs and psychotropic substances in a similar way, Larionov was fined under Art. 17.7 of the Code of Administrative Offenses (failure to comply with the legal requirements of the prosecutor).
On June 19, 2014, it became known about the submissions that the prosecutor's office of Ust-Katav of the Chelyabinsk region made to the leaders of the Ust-Katav Industrial and Technological College and the city CBS. The reason for the sanctions was that the libraries did not check the collections and incoming literature with the Federal List of Extremist Materials. In addition, the List was absent in the library of the technical school. Five people were brought to disciplinary responsibility.
On June 3, 2014, it became known about the submission made by the prosecutor's office of Gorno-Altaisk to the director of the Gorno-Altai College of Culture and Arts named after G.I. Choros-Gurkin due to the fact that the college library did not check the funds and incoming literature with the Federal List of Extremist Materials.
On May 20, 2014, it became known about the submission made by the prosecutor's office of Petropavlovsk-Kamchatsky to the directors of two branches of the Central City Library of Petropavlovsk-Kamchatsky. The reason for the sanctions was the lack of an updated version of the Federal List of Extremist Materials in the libraries.
On May 15, 2014, the prosecutor's office of the Jewish Autonomous Region reported that the prosecutor's office of the Oktyabrsky district had made three submissions to the heads of the secondary school in the village of Amurzet, the secondary school in the village of Ekaterino-Nikolskoye and the Inter-Settlement Library, four employees were brought to disciplinary responsibility. The reason for the sanctions was, in particular, the fact that the institutions did not have a Federal List of Extremist Materials and did not check the incoming literature against it.
On April 23, 2014, the prosecutor's office of the Aviastroitelny district of Kazan reported 10 submissions with a demand to eliminate the revealed violations of the law, submitted to the principals of the district's schools. The reason for the sanctions was the fact that school libraries did not check funds and incoming literature with the updated version of the Federal List of Extremist Materials.
On April 22, 2014, it became known that the prosecutor's office of ZATO Snezhinsk, Chelyabinsk region, made six submissions to the heads of city schools and the head of the Snezhinsk Education Department, as well as four lawsuits to eliminate violations of the law, which were satisfied by the court. The reason for the sanctions was that library collections were checked against outdated versions of the Federal List of Extremist Materials.
On April 15, 2014, it became known about the submission made by the prosecutor's office of Gorno-Altaisk of the Republic of Altai to the leadership of the correctional school I-II type of Gorno-Altaisk. The sanction, in particular, was due to the fact that the school library did not check the collections and incoming literature with the Federal List of Extremist Materials.
On April 15, 2014, the prosecutor's office of the Sverdlovsk region announced the submission made to the staff of the Sverdlovsk Regional Scientific Library named after V.I. V.G. Belinsky. The reason for the sanctions was, in particular, that the library did not have an updated version of the Federal List of Extremist Materials.
On April 11, 2014, the Yegoryevsk City Prosecutor's Office of the Moscow Region announced the submissions made to the directors of the Ramenskaya secondary school and schools No. 2 and No. 8 of the Yegoryevsky district. The reason for the sanctions was the fact that school libraries were not reconciled with the Federal List of Extremist Materials.
On April 10, 2014, it became known that the prosecutor's office of the Bayandaevsky district of the Irkutsk region filed 13 lawsuits against the administration of all schools in the district with claims that they were obliged to ensure the availability of the Federal List of Extremist Materials in libraries and to reconcile funds with it.
On April 9, 2014, the prosecutor's office of the Republic of Adygea reported 10 lawsuits against schools in the Koshekhablsky district, in which they demanded that the administrations of educational institutions be required to ensure that school libraries have a regularly updated version of the Federal List of Extremist Materials. The claims are under consideration. The prosecutor's office also made representations to the directors of these schools demanding that the responsible officials be brought to disciplinary responsibility. The reason for the sanctions was the absence of an updated version of the Federal List of Extremist Materials in 10 schools of the Koshekhablsky district, including school No. 7, discovered during the inspection.
On April 9, 2014, the Prosecutor's Office of the Seryshevsky District of the Amur Region reported on the submission made to the director of the secondary school in the village of Tomskoye, Seryshevsky District, which was caused by the fact that the school library did not have the Federal List of Extremist Materials and, accordingly, there was no reconciliation with it of funds and incoming literature, and also there was no log of reconciliations. It is reported that the violations have been eliminated, the librarian has been reprimanded.
On March 31, 2014, the prosecutor's office of the Republic of Mariy-El reported that the prosecutor's office of the Mari-Tureksky district had submitted a proposal to eliminate violations of the law on combating extremism against the director of the Khlebnikovskaya secondary school. The reason was that the school library did not check incoming literature with the latest version of the Federal List of Extremist Materials.
On March 25, 2014, the prosecutor's office of the Alekseevsky district of the Republic of Tatarstan announced the submissions made to the directors of schools in the villages of Mokrye Kurnali, Sakharovka and school No. G. Borovikov village Alekseevskoe. The reason for the sanctions was that reconciliation of funds and incoming literature was carried out in school libraries irregularly.
On March 19, 2014, it became known about the submissions to eliminate violations of the law, which the prosecutor's office of Blagoveshchensk, Amur Region, submitted to the directors of schools No. 4, No. 11, No. 12 and No. 14 of Blagoveshchensk. The reason for the sanctions was the absence of the Federal List of Extremist Materials in school libraries.
On March 5, 2014, it became known about the submissions that the prosecutor's office of the Monastyrshchinsky district of the Smolensk region submitted to the director of the Monastyrshchinsky MCBO and the head of the education department of the administration of the Monastyrshchinsky district. The submissions were considered and satisfied, 13 officials were brought to disciplinary responsibility. The reason for the sanctions was that 19 district libraries and 12 district school libraries did not have updated copies of the Federal List of Extremist Materials.
On February 26, 2014, the Prosecutor's Office of the Nukutsk District of the Irkutsk Region reported 11 statements of claim to the Nukutsk District Court, in which they demanded to oblige the leadership of municipal educational institutions to provide school libraries with copies of the Federal List of Extremist Materials and to conduct regular reconciliations of funds with the List.
On January 23, 2014, the prosecutor's office of the Kaluga region reported that the prosecutor's office of the Zhizdrinsky district protested against the heads of 10 schools in the district due to the fact that the provisions on school libraries did not contain a clause that would establish the procedure for reconciling funds and new receipts with the Federal List of Extremist materials. The protests were considered and satisfied in full.
On January 20, 2014, the Prosecutor’s Office of the Irkutsk Region reported that the Prosecutor’s Office of the Slyudyansky District filed 10 statements of claim with the court on the obligation of local educational institutions to ensure regular and timely receipt of the constantly updated Federal List of Extremist Materials in libraries and to conduct regular reconciliation of library funds with it. As reported, the claims of the prosecutor's office were satisfied in full, violations were eliminated.
On January 9, 2014, the Prosecutor's Office of the Stavropol Territory reported that the Essentuki City Prosecutor's Office had filed 12 lawsuits with the city court to oblige the administration of local educational institutions to reconcile library collections and new acquisitions with the Federal List of Extremist Materials. The reason was that such reconciliations are not carried out in the libraries of city educational institutions.
On December 30, 2013, the Vsevolozhsk City Prosecutor's Office of the Leningrad Region reported 13 submissions made to the heads of educational institutions in the district, as a result of which 21 officials were brought to disciplinary responsibility, and 4 warnings about the inadmissibility of violations of the law. Part of the prosecutor's response was due to the fact that the libraries of these institutions did not check the library stock with the Federal List of Extremist Materials. The exact number of sanctions is not reported.
On December 26, 2013, it became known that the prosecutor's office of the Monastyrshchinsky district of the Smolensk region submitted a proposal to eliminate the violation of the law to the director of the Monastyrshchinsky inter-settlement centralized library association and the head of the district education department. The reason for the sanctions was that 19 district libraries and 12 district schools did not have updated versions of the Federal List of Extremist Materials.
On December 20, 2013, the prosecutor's office of the Tambov region reported that the Rasskazovsky interdistrict prosecutor's office had submitted a proposal to eliminate violations of the law and bring the perpetrators to disciplinary responsibility against the director of the MBU Centralized Library System. The reason was that the printed version of the Federal List of Extremist Materials available in the library lagged behind the latest electronic version by 36 points, and in addition, there was no order to assign duties to one of the librarians to monitor updates of the Federal List and inform library staff about them.
On December 17, 2013, it became known about the submission that the prosecutor's office of the Sovietsky district of the Saratov region made to the head of the administration of the Sovietsky district. The reason for the sanction was that the district did not have a legal act defining a library authorized to register and account for a mandatory municipal copy of a printed publication, which, according to the prosecutor's office, leads to the absence of conditions for reconciling library collections with the Federal List of Extremist Materials.
On November 19, 2013, the prosecutor's office of the Ust-Kamchatsky interdistrict prosecutor's office of the Kamchatka Territory announced the submissions made by it to the heads of administrations of the Ust-Kamchatsky and Aleutsky municipal districts. The reason for the submissions was that in district and rural libraries there were no reconciliations of the library stock with the Federal List of Extremist Materials, and in some libraries the List was not known.
