In March 2008, Rosobrazovanie (later abolished and reorganized into the Ministry of Education and Science) provided
all Russian schools with licensed software packages, including
which is included in the Internet access content filtering program. How
it turned out that this program does not cope with the task, which was
found out as a result of prosecutorial checks throughout the country. Absolutely
it is obvious that the fault is that schoolchildren, despite access filters,
have the opportunity to visit neo-Nazi and
other inappropriate sites, lies not only with schools that do not update with
the necessary regularity of the software, but also at the Ministry of Education and Science, which installed an insufficiently effective product. Note
that not all items on the Federal List of Extremist Materials
designed in such a way that they can be used as a guide to
action (sometimes, when it comes to a site, its address can be reflected
not completely or even completely absent, but the titles of books and articles
are given without imprint).
Except
Moreover, we cannot but note that the very idea of fighting against
help filters with extremism in schools seems to us wrong. Firstly,
any filter can be bypassed if desired, and secondly, in principle
it is impossible to compile an exhaustive list of addresses and keywords.
Tem
nevertheless, prosecutors everywhere and regularly punish for this
local officials and school leaders. We believe that for imperfection
content filtering systems must comply with the Ministry of Education and Science, and
the negligence of the leadership of schools that do not update the program is a problem
rather labor discipline than law enforcement.
We have combined such cases into a single list, the first part of which covers the period from December 2009 to June 2011, and the second part covers the period from July 2011 to June 2012. The continuation of this list is in front of you.
- On November 25, 2013, the prosecutor's office of the Kurgan region reported that the prosecutor's office of the Mokrousovsky district had made submissions to the directors of two local schools demanding that violations of the law be eliminated and those responsible brought to justice. The reason was that the programs installed on school computers did not provide complete blocking of prohibited information.
- On November 22, 2013, the prosecutor's office of the ZATO Novouralsk, Sverdlovsk region, reported on the submissions made to school principals from. Taraskovo and the village of Pochinok. The reason for the sanctions was that school computers had access to materials included in the Federal List. From the news of the prosecutor's office it follows that the violation was detected when checking the content filtering, that is, there were filters on the computers.
- On November 22, 2013, it became known about the submission made to the director of the Mortkinskaya secondary school of the Kondinsky district of the Khanty-Mansiysk Autonomous Okrug-Yugra by the prosecutor's office of the Kondinsky district due to the fact that, despite the existing content filters, it was possible to access prohibited materials from school computers, in particular, films "Eternal Jew" and "Russia with a knife in the back 2".
- On November 21, 2013, the prosecutor's office of the Republic of Altai reported that the prosecutor's office of the Maiminsky district filed a lawsuit with the request to oblige the MBUK "Intersettlement Central Library" to install a content filter on computers that fully restricts visitors' access to prohibited information, since the existing content system - filtering does not cope with the task.
- On November 20, 2013, the prosecutor's office of the Khanty-Mansiysk Autonomous Okrug-Yugra announced that it had submitted submissions to eliminate violations of the law against the administration of 21 educational institutions in Nizhnevartovsk (as a result, 14 officials were brought to disciplinary liability), as well as branch No. 4 of the MBU "City Centralized Library". The reason was that access to prohibited information was possible from the computers of the institutions. We believe that in this case content filtering was performed, but did not provide complete protection.
- On November 19, 2013, the prosecutor's office of the Stavropol Territory announced the acts of the prosecutor's response to the results of an audit of the implementation of legislation on the protection of children from information that is harmful to their health, moral and spiritual development. In particular, the Georgiyevskaya inter-district prosecutor's office found that computers in libraries and computer classes in 13 schools had access to prohibited sites. It follows from the prosecutor's report that content filters were installed on the computers, since the case of their absence is described separately. The regional prosecutor's office also reported that there were no content filters in the Gornozavodsk special school of the closed type; while school computers are not connected to the Internet. The nature of the sanctions is not specified.
- On November 18, 2013, the prosecutor's office of Udmurtia reported that the prosecutor's office of the Karakulinsky district had made submissions to eliminate violations of the law against the directors of five local schools and sent six statements of claim to educational institutions to the Sarapulsky district court. The reason was that, despite the Parental Control system installed on school computers, access to prohibited information was not completely blocked. The court granted the demands of the prosecutor's office and ordered the schools to take measures to restrict access to prohibited sites, the guilty officials were brought to disciplinary responsibility.
- On November 14, 2013, the Prosecutor's Office of the Vologda Oblast reported that the Prosecutor's Office of Cherepovets had made representations to the directors of four local schools. It is reported that despite the fact that all educational institutions of the city have been connected to the regional content filtering node since 2011, the blocking of prohibited content was not completely carried out.
- On November 12, 2013, it became known about the submission made to the director of the children's library of the Central Library Library of the Ostrovsky district of the Kostroma region by the prosecutor's office of the Ostrovsky district of the Kostroma region. The reason for the sanction, in particular, was that the filters installed on the library computer did not work "properly" and gave access to extremist materials.
- On November 11, 2013, the St. Petersburg prosecutor's office reported that the prosecutor's office of the Vasileostrovsky district filed a lawsuit with a demand to oblige the administration of the "Central Library System of the Vasileostrovsky district" to exclude minors from accessing extremist materials online. The reason was that installed on the computers of the Central District Children's Library and the Youth Library. N. Ostrovsky's "Parental Control" system did not work.
- On November 7, 2013, the Kingisepp City Prosecutor's Office of the Leningrad Region reported two complaints made to school principals in the city (numbers not specified) in connection with the access to prohibited websites from school computers. It is not entirely clear from the prosecutor's report whether content filters were installed on the computers, but we assume that otherwise the prosecutor's office would have indicated their absence.
- On November 6, 2013, it became known about the submissions made to the directors of the Borisoglebsk school No. 1 and the Yurkinsky school by the prosecutor's office of the Borisoglebsk district of the Yaroslavl region. The reason for the sanctions was that the content filters installed on school computers " do not fully " block access to prohibited materials.
- On October 31, 2013, the prosecutor's office of the Bryansk region reported that the prosecutor's office of the Mglinsky district had 24 protests demanding that the regulation on access to the Internet, introduced in 24 schools in the district, be cancelled. As the prosecutor's office points out, "clause 2.9 of this local legal act provides that due to the impossibility of technical and software means to achieve complete filtering of Internet resources due to their frequent updates, the educational institution is not responsible for accidental access to such information." From the point of view of the prosecutor's office, this provision is contrary to the law "On the Protection of Children from Information Harmful to Their Health and Development", according to which access to information disseminated through information and telecommunication networks, including the Internet, in places accessible to children, is provided subject to the application of administrative and organizational measures, technical, software and hardware to protect children from information that is harmful to their health and (or) development. From our point of view, there is no contradiction here. By approving such a regulation, schools did not abdicate their obligation to take measures to limit children's access to dangerous information, they only insured themselves, rightly pointing out the imperfection of the technical means of filtering. Remember, there are no perfect content filters. In connection with the regulations, the district prosecutor's office also submitted a proposal to the head of the Mglinsky district education department with a demand to eliminate violations of the law and bring the guilty officials to disciplinary responsibility. Acts of the prosecutor's response are under consideration.
- On October 24, 2013, the St. Petersburg prosecutor's office reported that the Nevsky district prosecutor's office made two submissions to the director of secondary school No. 512 and the administration of the Nevsky Central Library System. The reason was that the filters installed on computers at school No. 512, as well as in the Library No. 2 named after. F. Abramov and Children's Library No. 11, did not fully block access to extremist sites.
- On October 23, 2013, the prosecutor's office in Zarinsk, Altai Territory, reported on a submission made to the director of one of the city's schools, which was caused by the content filters on school computers " not fully " excluding access to prohibited information. In particular, the inspectors were able to open sites with the lyrics of the songs of the Kolovrat group and the book Ancient Vedic Rus', the Basis of Existence.
- On October 21, 2013, the Prosecutor's Office of the Leningrad Region reported that the Kirishi City Prosecutor's Office made 8 submissions to the heads of local educational institutions. The reason was that from the computers installed in the computer science classes, it was possible to access extremist sites. It is not entirely clear from the report whether content filters were installed on the computers, but we assume that otherwise the prosecutor's office would point out their absence.
- On October 21, 2013, the prosecutor's office of the Saratov region reported that the prosecutor's office of the Saratov region had made a submission to the director of the secondary school in the village of Dubki. The reason was that the content filter installed on school computers did not fully cope with the task.
- On October 3, 2013, the prosecutor's office of the Stavropol Territory reported that the prosecutor's office of the Stepnovsky district had made submissions to eliminate violations of the law against the directors of nine schools (secondary school No. 2, 3, 4, 5, 6, 7, 10, 14 and No. education department of the district administration. It is reported that as a result, 14 persons were brought to disciplinary responsibility, and the identified violations were eliminated. The reason for making submissions was that the content filters installed on school computers did not fully restrict access to extremist materials.
- On September 27, 2013, information appeared that the Dankovskaya inter-district prosecutor's office of the Lipetsk region made a submission to the director of school No. 1 Dankov. The reason for the sanctions was the " untimely update " of the content filtering system, which allowed inspectors from the prosecutor's office to read from school computers the text of a certain song included in the Federal List of Extremist Materials.
- On September 27, 2013, it became known about six lawsuits filed by the prosecutor's office of the Shebalinsky district of the Altai Republic against the directors of the district's schools to restrict access to extremist materials. The reason for the lawsuits was that access to prohibited materials was possible from school computers, according to the prosecutor's office, due to " failure to take exhaustive measures to restrict access ." The Shebalinsky District Court terminated the proceedings in these cases due to the voluntary fulfillment of the plaintiff's claims.
- On September 6, 2013, it became known that the prosecutor's office of the Kurchaloevsky district of the Chechen Republic made eight submissions to the principals of the district schools: No. 1, 2, 3 Mayrtup, No. 1 and 4 Bachi-Yurt, No. 1 and 2 Tsotsi-Yurt, No. 3 Kurchaloy and filed in regarding them eight cases of administrative offenses under Part 1 of Art. 6.17 of the Code of Administrative Offenses (violation of the established requirements for the distribution among children of information products containing information that is harmful to their health and (or) development). The reason for the sanctions was that access to extremist materials was possible from school computers. It is not entirely clear from the report whether content filters were installed on the computers, but we assume that otherwise the prosecutor's office would point out their absence.
- On August 28, 2013, the prosecutor's office of the Tver region reported that the prosecutor's office of the Konakovo district filed a lawsuit to declare illegal the inaction of the administration of nine schools in the district (evening secondary school in the city of Konakovo, secondary schools No. Kozlovskaya, Novozavidovskaya, Redkinskaya, Dmitrovogorskaya, Zavidovskaya secondary schools) "in terms of failure to protect students from information that is incompatible with the tasks of upbringing and education" . The reason was that the content filters installed on school computers did not cope with the task. According to the prosecutor's office, after the prosecutor's appeal to the court, the violations were eliminated.
- On August 26, 2013, the prosecutor's office of the Republic of Tatarstan reported that the prosecutor's office of the Alekseevsky district had issued warnings against violations of the law on countering extremist activity to 25 educational institutions in the district. The reason was that the content filters installed on the computers of institutions do not fully restrict access to prohibited information on the network.
- On July 18, 2013, it became known about the submissions made by the Budennovskaya Interdistrict Prosecutor's Office of the Stavropol Territory to the principals of schools No. 3, 4, 5 of Budennovsk and No. 3, 6, 15 of the Budennovsky district, as well as the relevant departments of education. The reason for the sanctions was that, despite the established content filters, it was possible to access extremist materials from computers installed in schools.
- On July 17, 2013, the prosecutor's office of the Sretensky district of the Trans-Baikal Territory reported on the revealed " fact of improper functioning of the filtration system " in the school of the district, in particular, which allowed access to Hitler's book "Mein Kampf". Sanctions of the prosecutor's office are not specified.
- On July 8, 2013, the prosecutor's office of the Kaluga region reported that the prosecutor's office of the Sukhinichsky district had made submissions to eliminate violations of the law against the administration of the Strelnenskaya secondary school, the Frolovo-Goretovskaya basic comprehensive school and secondary school No. 2. The reason was, in particular, that the content filters installed on school computers did not prevent access to extremist materials. It is reported that disciplinary sanctions were imposed on the perpetrators.
- On July 5, 2013, it became known that the administration of a secondary school in the city of Chagoda, Vologda Oblast, was fined by the Magistrate's Court at the suit of the Prosecutor's Office of the Chagodoshchensky District for 20 thousand rubles under Part 2 of Art. 6.17 of the Code of Administrative Offenses of the Russian Federation (violation of the legislation of the Russian Federation on the protection of children from information that is harmful to their health and (or) development). The reason was that the content filtering system installed on school computers did not cope with the task, and students had access to information of extremist and pornographic content on the network.
- On July 2, 2013, the Prosecutor's Office of the Kursk Region announced the demands to ban access to extremist information, put forward to the directors of 27 schools in the Kursk Region in 16 districts due to the fact that school computers had not installed a "proper" content filtering system (most likely, this means that there were content filters in schools).
- On July 1, 2013, it became known that the prosecutor's office of the Takhtamukaysky district of the Republic of Adygea made 15 submissions and brought 3 protests. The reason for at least part of the sanctions was that the computers of the local governments of the administrations of the settlements of the district were not equipped with content filters. The incident is included in this compilation, since local governments should not install content filtering systems at all, since they are not educational institutions.
- On June 28, 2013, it became known about 12 submissions that the prosecutor's offices of the Leninsky, Zadneprovsky and Industrial districts of Smolensk made to the heads of the city's universities. The reason for the submissions was that the libraries and computer classes of 12 higher education institutions had access to extremist materials. Information about the presence or absence of a content filtering system in these universities is not provided.
- On June 27, 2013, it became known about the submission made by the prosecutor's office of the Chkalovsky district of Yekaterinburg to the director of gymnasium No. 39 in Yekaterinburg, as well as about 21 warnings announced by the prosecutor's office to the leadership of the district's schools. The reason for the sanctions was that the content filters installed on the computers in the gymnasium did not prevent access to two sites containing prohibited materials.
- On June 26, 2013, the prosecutor's office of the Kirovsky district of Yaroslavl reported on the submissions made to the directors of Yaroslavl schools No. 42 and 43. The reason for the sanctions was that the content filters on school computers did not meet "established requirements" and allowed access to extremist materials.
- On June 27, 2013, the Prosecutor's Office of the Republic of Kalmykia reported that the Prosecutor's Office of the Tselinny District had submitted proposals to eliminate violations of the law to the directors of local educational institutions. The reason was that the content filtering system installed on the computers of educational institutions did not prevent access to links to extremist materials.
- On June 26, 2013, the prosecutor's office of the Yaroslavl region reported that the prosecutor's office of the Kirovsky district had made submissions to the directors of schools Nos. 42 and 43 to eliminate violations of the law on protecting children from negative information distributed on the network. The reason was that the filtering system installed on school computers did not fully cope with the task.
- On June 21, 2013, it became known about the submission made by the prosecutor's office of the Batetsky district of the Novgorod region to the chairman of the education committee of the administration of the Batetsky municipal district. The reason for the sanctions was that access to extremist materials was possible from computers in the school in the village of Gorodnya. It is not entirely clear from the report whether content filters were installed on the computers, but we assume that otherwise the prosecutor's office would point out their absence.
- On June 20, 2013, the prosecutor's office of the Tselinny district of the Republic of Kalmykia reported on the submissions made to the directors of district schools (the exact number was not reported), due to the fact that the content filters installed on school computers did not prevent access to extremist materials.
- On June 17, 2013, it became known about a lawsuit filed by the Prosecutor's Office of the Konoshsky District of the Arkhangelsk Region with the Konoshsky District Court of the Arkhangelsk Region against a school in the village of Konosha demanding that school computers be provided with content filters that prevent students from accessing extremist materials. According to the prosecutor's office, the school " cannot rule out the possibility" of visiting prohibited sites. The defendant satisfied the claims voluntarily. It is not entirely clear from the lawsuit report whether filters were installed on school computers, but we assume that otherwise the prosecutor's office would point out their absence.
- On June 17, 2013, it became known that the Prosecutor's Office of Revda of the Sverdlovsk Region filed a complaint with the directors of the Revdinsky Pedagogical College and the Revdinsky Multidisciplinary Technical School due to the fact that despite the content filters installed on the computers of educational institutions, access to extremist materials was possible from them.
- On June 10, 2013, the prosecutor's office of the Turkovsky district of the Saratov region reported 10 submissions made to school directors of the Turkovsky district. The reason for the sanctions was that the content filters installed on school computers " not fully " prevented access to extremist materials.
- On May 31, 2013, it became known that the prosecutor's offices of Nolinsky, Belokholunsky, Darovsky, Yaransky, Verkhnekamsky, Tuzhinsky districts of the Kirov region, Leninsky district of Kirov made a number of submissions to school principals and sent statements of claim to the court. The reason for the sanctions was that content filters installed on school computers did not block access to extremist materials.
- On May 30, 2013, the prosecutor's office of the Smolensk region reported that the prosecutor's office of the Industrial District of Smolensk had made submissions on the elimination of violations of the legislation on education and on countering extremism against the heads of seven higher educational institutions of the district. The reason was, in particular, that from the computers installed in universities it was possible to access materials recognized as extremist, and there was no Federal List of Extremist Materials. Submissions are under consideration. Information about the presence or absence of a content filtering system in these universities is not provided.
- On May 29, 2013, it became known that the prosecutor's office of the Dobrinsky district of the Lipetsk region made submissions to the directors of the Mazeyskaya and Petrovsky district schools and the head of the Dobrinsky central inter-settlement library. The submissions were made due to the fact that the content filters installed on school and library computers " do not block unwanted resources in full " and make it possible to access materials recognized as extremist.
- On May 29, 2013, it became known that the prosecutor's office of the Spas-Demensky district of the Kaluga region made five submissions to the directors of district schools, in particular, the director of the school in the village of Chiplyaevo. The reason for the sanctions was that, despite the content filters installed on school computers, schoolchildren had access to extremist materials.
- On May 27, 2013, the Prosecutor's Office of the Moscow Region reported that the Prosecutor's Office of Ivanteevka had submitted proposals to eliminate violations of the law on countering extremism against the head of the city. The reason was that the content filtering system installed on computers in the reading room of the Central District Library. I.F. Gorbunova, did not fully cope with the task. As reported, the submission was considered and satisfied, and measures were taken to eliminate violations. We believe that in this case, although the submission was addressed to the head of the city administration, disciplinary sanctions may be imposed on the library management.
- On May 27, 2013, the prosecutor's office of the Saratov region reported that the prosecutor's office of the Turkovsky district had made submissions to eliminate violations of the law on countering extremism and bring the perpetrators to disciplinary action against the principals of 10 schools in the district. The reason was that the content filtering system installed on school computers did not fully cope with the task.
- On May 24, 2013, the prosecutor's office of the Yamal-Nenets Autonomous Okrug reported that the prosecutor's office of Salekhard had made 5 submissions to eliminate violations of the law on countering extremism against the directors of the MOU "Secondary School No. 4", the MOU "Secondary School No. 2", the MAO "Gymnasium No. 1", MBOU "Secondary school with in-depth study of individual subjects", SBEI SPO Yamalo-Nenets Autonomous Okrug "Yamal Polar Agro-Economic College". The claims of the prosecutor's office were caused by the low level of effectiveness of the content filters installed on the computers of educational institutions, in particular, the lack of competent software settings. It is reported that the violations were eliminated in full by the formation of a "white list" of sites involved in the educational process by the leadership of educational institutions. 9 officials were brought to disciplinary responsibility.
- On May 23, 2013, the prosecutor's office of the Khanty-Mansi Autonomous Okrug-Yugra reported that the prosecutor's office of the city of Langepas filed a lawsuit to compel most of the district's schools to block access to extremist websites, which the content filters installed on school computers could not block.
- On May 22, 2013, the Kemerovo prosecutor's office announced the submission made to the rector of the Kemerovo State University of Culture and Arts. The reason for the presentation was that content filters were not installed on the computers available in the reading room of the university's scientific library, which made it possible to access extremist materials. The episode is included in our selection because the claims here are identical to the usual claims against schools. In addition, libraries are not educational institutions and are not included in the program for the mandatory installation of content filtering systems.
- On May 8, 2013, the prosecutor's office of the Pronsky district of the Ryazan region reported on the submissions made to the directors of the Novomichurinsk school No. 2 and the Pronsk school in connection with the fact that it was possible to download Hitler's book "Mein Kampf" from computers in school computer science classrooms. It is not clear from the prosecutor's report whether content filters were installed on the computers, but we assume that otherwise the prosecutor's office would have indicated their absence. On May 20, 2013, it became known that filters were installed on school computers, and the text of Hitler's book was found by inspectors, in particular, in the Internet archive (web.archive.org).
- On May 8, 2013, it became known about 16 statements of claim on the obligation to eliminate violations of the law, sent by the Kovylkinsky Interdistrict Prosecutor's Office of the Republic of Mordovia. The reason for the response was that the computers installed in the checked schools had the opportunity to read extremist materials. It follows from the prosecutor's report that access was only to certain prohibited materials, which indirectly indicates the presence of content filters.
- On April 30, 2013, it became known about the submissions made by the prosecutor's office of the Atyashevsky district of the Republic of Mordovia to the directors of Vecherleiskaya, Kozlovskaya and Poselkova secondary schools due to the fact that despite the established content filters, access to extremist materials was possible from school computers.
- On April 30, 2013, the Solntsevskaya Interdistrict Prosecutor's Office of Moscow reported a lawsuit to the Solntsevsky District Court of Moscow against the station of young technicians "Solntsevo", in which it requires the installation of a " functioning filtering system " on computers. It follows from the report of the prosecutor's office that computers available at the station of young technicians had access to extremist materials, but it cannot be concluded that they did not have content filters.
- On April 23, 2013, it became known about the submissions made by the prosecutor's office of the Yelets district of the Lipetsk region to the directors of schools in the village of Bolshie Izvala, the village of Khmelitsev and the village of Golikovo due to the fact that the content filtering system installed in the informatics classrooms "did not fully meet the requirements of the information security " and allowed access to extremist materials.
- On April 23, 2013, it became known about 9 submissions made by the Atkar Interdistrict Prosecutor's Office of the Saratov Region to the directors of district schools. The reason for the sanctions was that school computers had access to extremist materials. It is not clear from the prosecutor's report whether content filters were installed on the computers, but we assume that otherwise the prosecutor's office would have indicated their absence.
- On April 18, 2013, the prosecutor's office of the Smolensk region reported that the prosecutor's office of the Novoduginsky district had made submissions about the inadmissibility of violating the law against the directors of 10 local schools. The reason was, in particular, that the content filters installed on school computers did not fully cope with the task.
- On April 17, 2013, it became known that the prosecutor's office of the Lagansky district of the Republic of Kalmykia filed a lawsuit against the heads of 7 district schools to restrict access to extremist materials. The reason for the lawsuits was that the content filters installed on school computers " do not restrict students' access " to prohibited sites. Two statements of claim were satisfied, the proceedings on the rest of the cases were terminated due to the voluntary fulfillment of the requirements of the prosecutor's office.
- On April 17, 2013, the prosecutor's office of the Central District of Togliatti, Samara Region, announced the submissions made to the directors of the Togliatti College of Service Technologies and Entrepreneurship, the Togliatti interschool educational complex and school No. 5. The reason for the sanctions was that computers installed in educational institutions could access to extremist materials. From the message of the prosecutor's office it follows that the content was filtered, but the persons responsible for it " implemented" monitoring "untimely " and did not add banned sites to the "black list". It is also reported that the prosecutor's office sent 48 statements of claim to the court of the Central District of Tolyatti to prohibit access to extremist materials.
- On April 17, 2013, it became known about 8 submissions made by the prosecutor's office of the Zhizdrinsky district of the Kaluga region to the directors of schools in the Zhizdrinsky district. The reason for the sanctions was that despite the installed content filters, it was possible to access A. Hitler's "Mein Kampf" from school computers.
- On April 9, 2013, it became known about the submission made by the prosecutor's office of the Perelyubsky district of the Saratov region to the head of the education department of the Perelyubsky district. The submission was made due to the fact that the content filters installed on computers in the district's schools " do not fully " prevent access to extremist sites.
- On April 4, 2013, the prosecutor's office of the Tula region announced that the Novomoskovsk city prosecutor's office had made submissions to eliminate violations of the law against the heads of the Novomoskovsk Polytechnic College and secondary school No. 17. The reason was that the filters installed on the computers of educational institutions did not completely block access to extremist materials.
- On April 4, 2013, the prosecutor's office of the Republic of Komi reported that the prosecutor's office of the Izhemsky district had submitted a proposal to eliminate violations of the law to the head of the administration of the Izhemsky district.
