On July 2, 2012 it became known that on June 1, 2012 The Oktyabrsky District Court of St. Petersburg rejected the claim of the city prosecutor's office and refused to recognize as extremist the film "Psychiatry. Industry death" and 21 more pamphlets on the critique of psychiatry and abuse of psychiatrists, issued by the St. Petersburg branch of the Civil Commission on Human Rights (CCHR), an international human rights organization, associated with the Church of Scientology.
The prosecutor's office insisted that the CCHR materials were sent to on inciting social discord against psychiatrists. The Court has reviewed a number of expert opinions of psychologists, criminologists and linguists from Moscow and Petersburg and came to the conclusion that in this film and texts there are no appeals to the implementation of extremist activity, its justification or substantiation. Court considered that the materials of the CCHR are sustained in the mainstream of scientific controversy, they contain consistent criticism of the methods of treatment existing in modern psychiatry and diagnostics. And although they contain negative information about a group of people, united by profession (psychiatrists, psychologists, psychoanalysts), and about individual representatives of this group, there is no inducement to violence against them or to defeat them in their rights; CCHR proposes only to impose certain restrictions on their activities. Court pointed out that the opinion of the authors of the materials may be controversial, however, freedom the expression of such an opinion is guaranteed by the Constitution of the Russian Federation and the Convention for the Protection human rights and fundamental freedoms.
On June 6, 2012, the prosecutor filed an appeal against the decision Oktyabrsky District Court, motivating it with formal reasons: the court announced in court session only the operative part of the decision.
Recall that the Owl Center consistently opposes an overly broad interpretation of the term social group in anti-extremist legislation. From our point of view, under his protection only particularly vulnerable social groups, to which psychiatrists, like representatives of other professions, do not belong.
On August 31, 2012, it became known that the city court of St. Petersburg rejected the protest of the prosecutor's office against the decision of the Oktyabrsky district court.
