In Karelia, the court refuses to place the author of an anti-clerical note in a mental hospital

August 1, 2012 Petrozavodsk The city court rejected another petition of the investigator Investigation Department for the Muezersky District of the Investigation Department of the Investigative Committee of the Russian Federation for Karelia on the premises of the Chairman of the Youth human rights group of Karelia Maxim Yefimov, against whom a criminal case was initiated under Part 1 of Art. 282 of the Criminal Code of the Russian Federation (incitement of hatred or enmity, as well as humiliation of human dignity on the basis of attitude to religion), to a mental hospital for a judicial psychological and psychiatric examination. The Court held that, according to the Constitution and the decision of the Constitutional Court, the court of first instance did not can make decisions about placing people in a mental hospital without their personal participation in the court session. Efimov and his lawyer were absent from the court session.

As a reminder, on June 28, 2012, the Supreme Court of Karelia recognized unlawful the decision of the Petrozavodsk City Court to place Efimov in hospital at the request of the investigation. On July 17, the investigation was forced to withdraw petition.

Meanwhile, Efimov has been behind the scenes since the second half of May. border. The investigation sent the materials of the Efimov case to the Ministry of Internal Affairs for Karelia to put him on the international wanted list.
