The chairman of the OPP is accused of slandering the leadership of the Cathedral of Christ the Savior

September 18, 2012 regarding Chairman of the Society for the Protection of Consumer Rights Mikhail Anshakov initiated a criminal case under Art. Art. 128.1 of the Criminal Code of the Russian Federation (slander). He accused of spreading slanderous information about the leadership of the Christ Temple Foundation Savior.

The reason was the appeal of the OZPP to the court with a claim for misuse use of the HHS premises. The statement of claim of the OZPP itself, according to M. Anshakov, "left without movement" .

On October 12, 2012, it became known that the case of M. Anshakov considers the Magistrate's Court of the Begovoy District, and not on criminal, but on administrative article - for hours.3 Article. 5.60 of the Code of Administrative Offenses of the Russian Federation (slander).

Since this article was removed from the list on July 28, 2012 of the Code of Administrative Offenses, the defendant filed a motion to dismiss the case. The court rejected the application M. Anshakova, arguing that at the time the offense was committed, the article The Code of Administrative Offenses was in effect. Since then it was transferred to the Criminal Code, and the law does not have retroactive effect, and the position of the defendant cannot be worsened, his will be judged according to the law in force at the time of the offenses.
