On October 4, 2012, the Orenburg Regional Court, considering 14 appeals against the decision of the Leninsky District Court of Orenburg to recognize 68 Islamic materials as extremist, appointed a new literary examination of the case.
The prosecutor's office requested an examination. The court rejected the proposal to entrust the examination to the Russian Federal Center for Forensic Expertise under the Ministry of Justice of Russia or another authoritative expert institution and assigned the execution to the authors of the previous examination, which was the basis for the decision of the court of first instance.
Representatives of Dilya Publishing House LLC and Sh.R. Alyautdinova filed counterclaims for the exclusion of their books from the Federal list of extremist materials.
Recall that in March 2012 The Leninsky District Court at once banned almost the entire library, confiscated during search of a resident of Orenburg Asylzhan Kelmukhambetov, convicted in June 2011 under Part 1 of Art. 282.2 of the Criminal Code of the Russian Federation (organization of the activities of an extremist organization) for the creation of a cell "Nurcular". The court justified the ban on books by the fact that this literature allegedly characteristic of " representatives of the movement "Nurcular ", " the group that owned the confiscated library refers to international movement "Nurjular ", and the content of the texts is aimed at " changing the subjective reality of the individual, his system values and beliefs, relationships in society, while an attempt to subconsciously influence the psyche and influence the mechanisms faith, that is, the formation of conscious values and beliefs on an irrational basis ." After reviewing some of the texts, we did not find any signs of extremism in them. Except In addition, we consider it unlawful to persecute believers who study unreasonably banned in Russia books by Said Nursi. As for the movement "Nurcular", to which they are ranked, on the territory of Russia it never existed.
