Explosion on Manezhnaya Square: the verdict is overturned, the case is sent for a new trial

January 16, 2013 Judicial Collegium for Criminal Cases The Supreme Court of the Russian Federation considered the complaint against the verdict of the Tverskoy District Court Moscow, which in 2009 was brought against student Ivan Belousov in the case about the explosion of a lamppost on Manezhnaya Square.

Recall that the explosion occurred at the Okhotny Ryad shopping center on Manezhnaya square on 27 December. The lamppost collapsed from the explosion, the nearest lanterns scattered and the sign over the main entrance was damaged.

According to investigators, it was I. Belousov who laid the explosive device, and unknown accomplices brought the device into action.

The young man was charged with Part 2 of Art. 213 of the Criminal Code of the Russian Federation (hooliganism) and part 1 of Art. 222 of the Criminal Code of the Russian Federation (illegal possession of explosives). Tverskoy District Court of Moscow sentenced him to 6 years deprivation of liberty.

In 2009, the Moscow City Court was filed appeal, but it was dismissed. In April 2010, the Moscow City Court rejected the supervisory appeal , in which the lawyers of I. Belousov insisted on annulment of the court decision and termination of proceedings on the case, referring to violations of criminal procedure legislation and inconsistency of conclusions court on the facts of the case.

Now the Judicial Collegium for Criminal Cases of the Supreme Court of the Russian Federation decided to cancel the verdict of the Tverskoy District Court dated August 27 2009 and the cassation ruling of the Moscow City Court dated November 18, 2009. Case sent for re-examination.
