The trial of the alleged killer Yuri Budanov, who began in December 2012 in the Moscow City Court with the participation of a jury, did not promise sensations. According to investigators, the former colonel was shot by Yusup Temerkhanov, a non -working native of Chechnya, living in Moscow. He took revenge on Budanov for the death of his father, who, on the night of February 12-13, 2000, shot three unidentified military personnel of military unit No. 73881 in the village of Geldagan Kurchaloevsky district.

Temerkhanov, he believes the accusation, was hatred and enmity of all the servicemen who served in Chechnya, and chose Budanov as the most odious figure*. According to investigators, June 10, 2011 Temerkhanov shot at Budanov six times and disappeared by the Mitsubishi Lancer car.

Eyewitnesses of the murder were several people. One of them, 50-year-old driver Alexander Yevtukhov, immediately after the New Year holidays was in the center of the scandal.

Key witness

In the summer of 2011, Alexander Yevtukhov worked at Intervo LLC and on June 10 smoked at the entrance to the office on Komsomolsky Prospekt. So he became an involuntary eyewitness to the murder of Budanov: when the killer got into the car, Yevtukhov for some reason ran after the car, trying to write down the number on the move. A few days later, he already gave investigators an testimony of how the killer looked. “His hair was not red, firing not a blond, but not a brown -haired one, his hair is not black, but bright. There were black sunglasses on the man, ”says the protocol of his interrogation of June 20, 2011.

Yevtukhov was a witness to the prosecution, but for some reason the prosecutors did not call him to the court, and when the lawyer of the defendant Murad Musaev asked Judge Korotkov to call Yevtukhov, he said that if he needed protection, let them bring him.

“I was very surprised when the lawyer Musaev called me and asked which colony my husband was serving a deadline,” Evtukhova, Elena Lesh, told The New Times. -Sasha recently lived in Novosibirsk because of his mother's illness. And they told the lawyer that he was supposedly sitting in a colony. ”

Yevtukhov’s speech at the trial was necessary to prove the innocence of the defendant. After all, he said that Killer had blond hair. Meanwhile, the defendant Temerhanov is a burning bald brunette.

“In the testimony given at the preliminary investigation, the witness Yevtukhov not only described the person who shot at Budanov. He stated that he could identify him, ”the lawyer Musaev told The New Times. - Why did not investigators present him with the accused Temerkhanov? And why did the prosecutors not want to interrogate him in court? "

Twice stolen

On January 9, a colleague of Musaeva, lawyer Daria Train, phoned Yevtukhov and came to him in Novosibirsk. She persuaded him to speak at the process. Yevtukhov said that he needs 100 thousand rubles for trips to Moscow and for all expenses. Training transferred this money to his bank card.

And then the events began to develop rapidly. On January 14, Yevtukhov flew to Moscow. But the process was moved: prosecutors said that the son of Budanov fell ill. Going to return to Novosibirsk, the witness arrived at Domodedovo Airport and registered on a flight. As he later told his wife on the phone, unknown people in civilian clothes approached him. They detained him for a conversation, which dragged on all night. And in the morning he still flew to Novosibirsk.

“Sasha called me from there and said: the opera wanted him to change his testimony,” says Elena. “They asked him not to call anyone: neither relatives nor lawyers, only to them.” I told about all the lawyer Daria. ”

On January 18, Yevtukhov was going to come to the meeting of the Moscow City Court again. But, according to lawyers, he was again stolen.

“Murad Musaev asked me to fly to Barnaul for this witness,” lawyer Alexei Egorov told The New Times. - We agreed with him that he would come from Novosibirsk to Barnaul by car, and I would fly up and we will return to Moscow together. Having arrived in Barnaul, I immediately called him, but he did not answer. At the registration rack, I learned that Yevtukhov registered on-line. He did not come for landing. Then I called his niece, in whom he stopped in Barnaul. She gave me a taxi number on which he went to the airport. I met with a taxi driver, and he told me that 500 meters to the airport was stopped by the airport under the pretext of checking the documents. He went to open the trunk, and at that time four people left the white minibus with Novosibirsk numbers, showed some crusts, asked the passenger: "Are you Alexander?" Then they brought him out of the taxi, put him in a minibus and left. The opera at the Novosibirsk Airport, with whom I spoke, made me understand that Yevtukhov was abducted by representatives of the special services. "

Lawyer Egorov told Musaev that the witness was abducted, his relatives in Moscow began to alarm.

And at 21.22, the RAPSI agency published information that Yevtukhov called them and said that he had not disappeared anywhere, but simply changed the phone number. However, he did not appear at home at home on Saturday or Sunday.

Stolen or bribed?

On January 21, Yevtukhov, as from the air, appeared at a meeting in the Moscow City Court just at the moment when lawyers made a statement about the loss of a witness. There were no jury in the hall. He was introduced into the hall without an invitation, before that, the bailiffs were taken out of the corridor who was there, including his wife and lawyer Alexei Egorov.

“I asked the court to interrogate Yevtukhov about the circumstances of his abduction: why he could not fly to Novosibirsk on January 14, and on January 18, the judge removed all these issues,” says lawyer Musaev. - Then Yevtukhov repeated the testimony given to them during the investigation. And he added that Yusup Temerhanov had not previously seen and that the person who shot at Budanov, and the defendant are different people. The prosecutors precipitated. ”

Musaev says that the judge invited the jury. But before he started talking, the secretary approached the judge, told him something, and then he removed the jury from the hall and gave the floor to the state prosecutor Maria Semenenko.

She asked Yevtukhov if he received money from lawyers for these testimonies. He explained that he received money for travel, accommodation and other expenses. Judge Korotkov announced a break in the process until Monday.

Yevtukhov’s witness was taken out of the hall, and he again disappeared in an unknown direction. A little later, the press secretary of the Moscow City Court Anna Usacheva showed reporters two of his statements. He wrote that at a court hearing, the lawyer Musaev threatened him.

That evening, the representative of the Investigative Committee Vladimir Markin said that a system of protecting witnesses could be applied to Yevtukhov.

And on January 24, a criminal case was instituted against the lawyer of Daria Trainer about an attempt to bribe a witness.

What next?

The initiation of a criminal case against the training may force Murad Musaev’s lawyer to get out of the process. It is possible that he will be offered this in exchange for closing the case against his colleague.

The purpose of all this special operation is clear - to discredit the defense of Temerkhanov. Musaeva in law enforcement agencies and court is not very complained of: he knows how to "ruin" the case. Judicial journalists say that the lawyer Musaev bought everyone: Yevtukhov’s witness, his wife, journalists who are outraged by the scandalous situation.

True, so far the evidence of the bribery of Yevtukhov is quite weak: according to the law, lawyers have the right to pay the witness the road in case of his arrival at the court.

The main question: did Temerhanov killed Budanov or not? Maybe on the day of the murder he was in a wig, and therefore Yevtukhov noticed blond hair sticking out from under the baseball cap? The jury should understand this.

And who actually abducted the witness of Yevtukhov, whether the lawyers stole him at all or all this was invented by all this, we will find out only if Yevtukhov himself tells about this when, in fact, he will be released.

But the conclusion from this detective suggests itself disappointing: if you have witnessed the crime, then it is better not to give any testimony.
