February 11, 2013 in the Oktyabrsky District Court of Arkhangelsk a regular meeting was held in the case under Part 1 of Art. 282 of the Criminal Code (inciting hatred or hostility, as well as humiliation of human dignity) against Ivan Moseev, Director of the Pomor Institute of Indigenous and Minorities of the Northern Arctic Federal University, President of the Association of Pomors Arkhangelsk region.
Moseev presented an extrajudicial linguistic study conducted by specialists of the Nizhny Novgorod State University named after Lobachevsky. The authors of the study are Elizaveta Koltunova and Timur Radbil - considered that the statement incriminated to Moseev lacks " speech means that contribute to the justification or justify the need to carry out genocide, mass repression, deportations, committing other illegal actions, including the use of illegitimate violence against an ethnic group" and " statements containing justification and justification of the need to violate the rights, freedoms and legitimate interests of a person and citizen, depending on his nationality or ethnicity .
Recall that, from our point of view, the statement left on website "Echo of the North", which served as a pretext for initiating a criminal cases, can be attributed to hate speech, but it in no way gives grounds for criminal prosecution.
