In April 2013, the prosecutor's office of the city of Shelekhov, Irkutsk area during the audit revealed a certain group in the VKontakte network, in which systematically published photographs depicting Nazi symbols.
In this regard, the prosecutor's office sent a submission to the administration of the VKontakte website demanding to close access to the group, and against the administrator of the group - a minor K., an administrative case under Art. 20.3 of the Code of Administrative Offenses (propaganda and public demonstration of Nazi paraphernalia).
However, later it became known that K. had not yet reached the age of 16 age and therefore cannot be held administratively liable. Case was terminated for him.
However, the prosecutor's office did not stop there and sent materials in the case of K. to the Investigation Department for the Shelekhovsky District of the Investigation Department Investigative Committee of the Russian Federation for the Irkutsk region to resolve the issue of initiating against him criminal case.
It is not very clear to us what kind of criminal case can in this case we are talking about: the only article of the Criminal Code that could theoretically be charged with K., is Art. 282 of the Criminal Code of the Russian Federation (inciting national hatred), but it also requires that the accused, at the time the offense was committed, be over 16 years old.
