First criminal case: No. 139001. Investigators of the Main Investigative Committee of the IC of Russia in the Moscow Region Vladimir Yakunin and Alexander Haustov conduct this business. The accused is Alexander Ovchinnikov, the former head of the Krasnoarmeysk. He is accused of the fact that in 1992, as an employee of the Ministry of Defense, he received an apartment in Krasnoarmeysk; In 1998 he transferred to Moscow, where he was provided with housing at the place of service; In 2007, the apartment and grandson of Ovchinnikov were privatized an apartment in Krasnoarmeysk. Thus, according to the investigation, he made a major fraud, since he had to hand over one of the apartments. However, Ovchinnikov himself in his defense says: the case should be considered in the civil process, there was no fraud, the apartment, at his request, was already “imprisoned by his wife” and was given back to the municipality.

Against the backdrop of all these events, Ovchinnikov had health problems, and on February 7, 2013 he lay down in the hospital. From this moment, the story begins that interests us the most. Once in the hospital, Ovchinnikov on the phone and letters informed the investigators about where he was and what was happening to him. But on February 13, an investigation group appeared in the hospital, which, interviewing the doctors and taking off for some reason everything in the video, asked Ovchinnikov to the exit.

The interrogation lasted four hours, Ovchinnikov chose the option of subscribing to the distance, after which it was released almost at night, recommending to get to Krasnoarmeysk on their own. Now Ovchinnikov does not get out of the doctors, but this is not the worst of the possible consequences.

Second criminal case: No. 39124. All the same investigators of Hausta and Yakunin lead him. The accused is Alexander Zhukovsky, who, according to the investigation, made fraud with lands in the Krasnogorsk district. Zhukovsky and Ovchinnikov is defended by one lawyer - Felix Todorov. “When I got acquainted with the investigators in the Ovchinnikov case, I asked them why the case was initiated on January 9, on the first working day,” says Todorov. - To which they answered me that they could not before, because they shot “one” from the flight there. This “one”, as it turned out later, was Zhukovsky. I took his business in principle, already getting acquainted with the principles of the work of this investigative group using the example of Ovchinnikov. ”

The criminal case against Zhukovsky was opened on December 26, 2012 at 12 o’clock in the afternoon. The time here is important, because exactly on the same day, after three hours, the investigator Haustov makes a decree "On Removing from the flight and the drive of the suspect." Zhukovsky was going to rest with his wife, but they were removed from the ramp.

“The procedural legislation of the resolution on“ removal from flights ”is unfamiliar,” Anton Kamensky, a former employee of the Main Directorate of the IC of Russia in Moscow, a specialist in the field of criminal and criminal procedure law, is ironic. “Of course, the suspect can be driven, however, an unconditional condition is his refusal without good reason from the appeal to the investigator and the properly handed the agenda (or other notification).” That is, the investigator Haustov had to have time in three hours between the signing of both decisions to notify the suspect of initiating the case, to hand him the summons and get a disrespectful reason for the failure to appear. This resolution “On Riding” today walks throughout Moscow as an anecdote. The following analogies were offered to choose from: the decree “On removal from any vehicle, including a bicycle” or “On output from under a dropper”.

Three days after the withdrawal from the flight with Zhukovsky, a heart attack occurred. In March 2013, lawyer Todorov received a notice from investigator Haustov that Zhukovsky would be charged with the hospital on March 25. “I arrived there simultaneously with the investigative group,” says Todorov. - There we learned that Zhukovsky was in intensive care: his stomach ulcer opened after his heart, and then a heart attack happened again. It was obvious to me that our visit would end in this - it is impossible to carry out investigative actions with a person in intensive care. But investigators tried to go to him, telling the doctors that they would simply show a piece of paper. The conflict flared up: investigators rushed into intensive care, I, as best I could, did not let them in. They went to the head physician, and I felt how to do it bad from all this. ” As a result, Todorov on the same day was hospitalized with a hypertensive crisis: the lawyer was in intensive care, and then to the neighboring chamber to his client. Todorov from the hospital has already been discharged, and Zhukovsky has recently been placed in intensive care. “I just can't understand why all this? All the same can be done in the framework of the law and without the risk of killing a person, ”the former investigator is perplexed, and now the lawyer Todorov. - It seems that investigators throughout the country seemed to be given the FAS!
