The jury refused to consider Budanov's murder motivated by hatred of a social group

On April 29, 2013, a jury of the Moscow City Court issued a verdict in the case of the murder of Yuri Budanov. Yusup Temerkhanov was found guilty of murder, but the jury found that the crime was not committed out of hatred against a social group of servicemen.

Recall that Temerkhanov was charged under paragraph "l" of Part 2 of Art. 105 of the Criminal Code (murder motivated by hatred and enmity against a social group), Part 1, Art. 222 of the Criminal Code (illegal trafficking in weapons).

We applaud the jury's verdict. In our opinion, servicemen are not a social group protected by anti-extremist legislation; in addition, we consistently advocate the exclusion of the vague concept of "social group" from the composition of anti-extremist articles.
