Convicted of racist murder
On May 27, 2013, the Moscow City Court sentenced 22-year-old Daria Botvinskaya, accused of assaulting natives of Dagestan, committed in June 2007 in an electric train near Moscow.
At the time of the murder - June 10, 2007 - Botvinskaya was not yet 18 years old, she previously had a different surname - Tikhanova. Botvinskaya "always carried knives with her," the report says. Botvinskaya admitted that she participated in the attack on Ferzelaev, but said that she hit him on the head with a bottle "out of fright."
She was charged under s. "g", "l" part 2 of Art. 105 of the Criminal Code (murder committed by a group of persons by prior agreement on the motive of national enmity and hatred) and part 3 of Art. 30, paras. "a", "g", "l" part 2 of Art. 105 of the Criminal Code (attempted murder of two or more persons, committed by a group of persons by prior conspiracy, motivated by national enmity and hatred).
The court was skeptical about the testimonies of various eyewitnesses and recognized them as reliable only in the part where they are consistent with each other - namely, that the accused participated in the stabbing, having "intent to cause death." Arguments that she did not use a knife, the judge found unconvincing.
The judge gave her five years in prison, which she will have to serve after 14 years. The court took into account mitigating circumstances - a minor age at the time of the crime, the absence of a criminal record and the presence of a two-month-old child. According to the court decision, Botvinskaya will go to the colony when her son turns 14 years old. All these years she will be under house arrest and proper behavior. Korotkov also partially satisfied the civil claim of the victim. According to his decision, Botvinskaya will have to pay him 50 thousand rubles for moral and physical damage.
