On August 16, 2013, the Zamoskvoretsky District Court of Moscow recognized anti-fascist Igor Kharchenko guilty under Part 2 of Art. 213 of the Criminal Code (hooliganism, committed with the use of objects used as weapons, organized group, motivated by social hatred) and Art. 111 UK (intentional infliction of grievous bodily harm) and sentenced him to 3 years and 6 months in a strict regime colony. The punishment was imposed taking into account the served conclusions. In addition, in a civil suit, the court ordered him to pay the victim in compensation of 300 thousand rubles.
Is the motive of hatred imputed under Art. 111 of the Criminal Code, unknown.
Kharchenko accused of attacking far-right activists Vladlen Sumin and Vladimir Zhidousov July 4, 2010. Initially, he was also accused under Part 2 of Art. 282.1 CC (participation in the activities of an extremist community) and Art. 115 of the Criminal Code (intentional causing slight bodily harm), however, during the process, these charges were dropped ; accordingly, one of the two victims, Vladimir Zhidousov, was removed from the case.
Recall that the arguments of the defense about Kharchenko's alibi (at the time of the crime he was on the stage of the club) seem to us very convincing, but they were not taken into account by the court. In addition, we oppose the inclusion of nationalists in list of social groups protected by anti-extremist legislation, because they are not a vulnerable social group in need of protection, and advocate for the exclusion of the vague concept of "social group" from anti-extremist articles.
