In September 2013, a court in Moscow declared the article “Good luck to you, Shamil Basayev!” to be extremist. editor-in-chief of the newspaper "Radical Politics" Boris Stomakhin.
The Babushkinsky District Court of Moscow satisfied the claim of the Butyrskaya Interdistrict Prosecutor's Office and recognized Boris Stomakhin's article “Good luck to you, Shamil Basayev!”, posted on the website htt://sopritivienie.marsho.net, as extremist. The court's decision entered into legal force. The basis for the prosecutor's office's appeal to the court was the materials of an inspection conducted by the Center for Countering Extremism of the Internal Affairs Directorate for the North-Eastern Administrative District of Moscow.
“According to the conclusions of a psychological and linguistic study conducted by the state unitary enterprise “Center for Information and Analytical Research,” Stomakhin’s article “ contains signs of inciting discord, enmity and hatred towards government officials, law enforcement agencies and military personnel. In addition, the author agrees with the actions of terrorists ."
Let us recall that the editor of “Radical Politics” Boris Stomakhin was arrested in November 2012 for publications on the website “Resistance” (recognized as extremist in July 2012 and included in the Federal List of Extremist Materials (item 1521)) and on his personal blog, he was charged with Part 1 Art. 30, part 2 of article 205.2 (preparation for public justification of terrorism using the media).
In 2006, Boris Stomakhin was already convicted under Art. 282 of the Criminal Code of the Russian Federation (incitement of national hatred) and Art. 280 of the Criminal Code of the Russian Federation (public calls for extremist activities) for publishing the newsletter “Radical Politics”. He was released in March 2011. In May 2012, the Leninsky District Court of the city of Stavropol recognized Boris Stomakhin’s article “You will be free, Caucasus!” as extremist. In March 2012, the Leninsky District Court of Orsk, Orenburg Region, recognized Stomakhin’s article published on the Resistance website as extremist (item 1190 of the Federal List of Extremist Materials). In July and August 2012, the Inta City Court of the Komi Republic declared an article from Stomakhin’s “Resistance” website and the entire site extremist (among other things, the site published issues of his newspaper “Radical Politics”) (item 1474, item 1521 of the list). Roskomnadzor issued a warning to the editors of the publication "Century" for distributing on the Internet at the address of the material "Russia is being hindered by Russians... Selected statements of our liberals", which reproduces verbatim fragments of Stomakhin's article "Death of Russia!", recognized by the court as extremist material (we consider this warning illegal ). On November 28, 2013, the Central District Court of the city of Omsk recognized the publication of B. Stomakhin’s newspaper “Radical Politics” No. 2 for 2011 as extremist (we consider this ban to be partially unlawful). However, as it became known on April 24, 2013, this decision was overturned , and the case was sent for a new trial on newly discovered grounds.
