FAS for the fourth time introduces the Fourth Antimonopoly Package to the government, not agreed with other departments

The Federal Antimonopoly Service of the Russian Federation (FAS) for the fourth time introduced a package of amendments to the law "On Competition", among experts known as the "Fourth Antimonopoly Package". Earlier, these amendments deflected three times by the government, and this time they were not again agreed with the Ministry of Economic Development, the FST and the Ministry of Justice, the Kommersant newspaper reports.

Experts previously drew attention to the fact that the amendments proposed by the FAS do not take into account the order of the head of the Cabinet of Ministers Dmitry Medvedev, who ordered to work in the direction of liberalization of antimonopoly legislation.

FAS believes that the contradictions that arose in the process of assessing the regulatory effect can be removed. As for the large number of criticisms of experts, they were ignored by the FAS specialists, since "they diverge from the general concept of the project."

The amendments proposed by stubborn antitrusters suggest that dominant organizations will have to publish trading practices, control over operations within groups of companies will be tightened, and non -discriminatory access standards will not only be widespread.

In addition, in accordance with the document, the FAS receives powers in accordance with the process of creating any enterprise funded from the budget, and the right to reject the creation of joint ventures whose assets exceed 7 billion rubles.

The bill, with such persistence, promoted by the antimonopoly department, does not meet support among most departments that can be considered interested.

The Federal Tariff Service is especially radical. The head of the department insists that a larger number of FAS initiatives, submitted for consideration, were previously rejected due to the fact that they were mainly recognized as inappropriate.

The Ministry of Economics initially approved the draft amendments, but then changed its opinion on the results of public discussion. Experts left almost 100 negative reviews on it. As a result of the FAS initiative, they received a negative assessment of the regulatory impact, which formally deprives the document of chances for the coordination of the government.
