On Sakhalin, an anti-Semite was convicted, but not punished

In November 2013, a 25-year-old Internet user was convicted in Yuzhno-Sakhalinsk for anti-Semitic materials on the VKontakte social network.

The Korsakov city court passed a guilty verdict against a 25-year-old resident of Yuzhno-Sakhalinsk, who was found guilty under Part 1 of Art. 282 of the Criminal Code (incitement of hatred, enmity, as well as humiliation of the dignity of a person or a group of persons on the grounds of race, nationality, language, attitude to religion).

The young man was suspected of posting in the public domain on the VKontakte social network on his personal page "photos and video files with relevant comments to them, which, according to the conclusion of a forensic psychological and linguistic examination carried out in the case, are aimed at humiliating the dignity of a person and a group of persons on signs of nationality, namely Jewish nationality. In addition, he posted on his page a video file “SS Sakhalin”, which, according to the decision of the Yuzhno-Sakhalinsk city court, was recognized as extremist.

During the preliminary investigation, the defendant fully pleaded guilty and repented of his deed. However, he changed his testimony in court, partially admitted his guilt, namely, he did not deny that he had posted the indicated materials on his page on the social network, but he had no intent to incite hatred and enmity.

The court found the defendant guilty of committing the crime incriminated to him and sentenced him to 6 months of corrective labor with a deduction of 5% from wages to the state income. The Internet user was released from the execution of punishment due to the expiration of the statute of limitations for criminal prosecution.

The verdict was proclaimed in open court, but did not enter into force.
