"Maximum measure" recognized as extremist
In November 2013, the Central District Court of Komsomolsk-on-Amur recognized several issues of the Vysshaya Mera newspaper as extremist materials.
On November 26, 2013 it became known that the Central District the court of Komsomolsk-on-Amur satisfied the claim of the prosecutor's office of Komsomolsk-on-Amur and recognized as extremist materials the issues of the newspaper "Vysshaya Mera" No. 8 (July 2009), No. 24 (July-September 2010), No. 25 (October-December 2010), No. 27 (April 2011). Solution court entered into force.
According to the prosecutor's office, based on psychological and linguistic study, the texts of the newspaper contain " calls for the implementation of extremist activities, including changing the foundations of the constitutional building ."
Recall that, in particular, for the distribution of the newspaper "Vysshaya measure" May 8, 2013 Central District Court of Komsomolsk-on-Amur activists "Other Russia" Anton Lukin and Svetlana Kuznetsova were recognized guilty under paragraph "a" h. 2 Article. 282 of the Criminal Code (actions aimed at inciting hatred and enmity, committed with the use of violence or with the threat of its use), Part 1 of Art. 280 of the Criminal Code (public calls for extremist activity) and Part 3 of Art. 212 of the Criminal Code (calls riots) and sentenced to three and one and a half years in prison conditionally, respectively.
Please note that we do not have all the information on case, however, fragments of the imputed materials, known from the expert the conclusion underlying the accusation of Lukin and Kuznetsova, from our point of view view, cannot be regarded as calls for extremist activity, nor as statements that incite hatred. An accusation based on arguments, it seems to us unreasonable.
