Opposition activist Musa Abadiyev is on trial in Ingushetia, who is accused of inciting hatred against a social group of government officials.
In mid-February 2014, it became known about the going to Magassky district court of the Republic of Ingushetia, the trial of an opposition public activist Musa Abadiyev, who is charged under Part 1 of Art. 282 of the Criminal Code (actions, aimed at inciting hatred or enmity, as well as to humiliate dignity of a person by belonging to a social group).
On February 11, 2014, Abadiyev refused to be a state lawyer and requested that the case be postponed in order to search for a lawyer. The court session on February 19 was postponed at the request of the lawyer. The next hearing in the case has been rescheduled for March 3, 2014.
According to investigators, in early 2013 Abadiyev published in his blog article written shortly after the death of a social movement member "Mehk-Khel" Sultan-Girey Khashagulgov (who was killed as a result of special operations), and in this article made " incorrect statements, aimed at inciting hatred and enmity against a certain social group of persons .
The oppositionist himself reports that initially the case against him was initiated under Art. 319 of the Criminal Code (insulting a representative of the authorities in connection with the performance of his official duties), and then reclassified to Art. 282.
Abadiyev admits that he used incorrect wording in the article, which he then " crossed out ". The entry incriminated to him in LiveJournal is available for viewing, crossed out. In our opinion, in this text there are no signs of a crime under Art. 282 of the Criminal Code. The maximum that can be found in it is claims to the moral character of Russian "patriots" (as in the text; moreover, they are opposed to the "flower of the Russian people"), formulated not quite tolerantly, calls for the Russian people to convert to Islam, as well as invectives against Vladimir Putin.
The social group "authorities" is not mentioned in the text. Recall we We believe that representatives of the authorities are not a social group protected by anti-extremist legislation. Moreover, the decision of the Supreme Court RF dated July 28, 2011 says that " criticism in the media information of officials (professional politicians), their actions and belief in itself should not be considered in all cases as an act, aimed at humiliating the dignity of a person or a group of persons, since in in relation to these persons, the limits of permissible criticism are wider than in relation to individuals ."
