On July 8, 2014, the court satisfied the claim of Ivan Moseev, the head of the Association of Pomors of the Arkhangelsk Region, who demanded that the blocking of his bank card be recognized as illegal, and decided to pay the plaintiff a thousand rubles as compensation for non-pecuniary damage.
On July 8, 2014, the Oktyabrsky District Court of Arkhangelsk satisfied the claim Heads of the Association of Pomors of the Arkhangelsk Region Ivan Moseev, recognizing illegal actions of the Arkhangelsk branch of OJSC "Sberbank of Russia" to terminate operations on the plaintiff's bank account, and obligated to eliminate restrictions on the disposal of his own money.
In addition, the court decided to recover in favor of the applicant one thousand rubles in as compensation for non-pecuniary damage.
Recall that in March In 2013, Moseev was sentenced by the Oktyabrsky District Court of Arkhangelsk under Part 1 of Art. 282 Criminal Code (inciting hatred or enmity, as well as humiliation of human merit) to a fine. Even at the stage of litigation on the aforementioned case, Sberbank blocked Moseev’s card, citing a technical failure, and after sentencing blocked her completely, explaining this measure by the fact that Moseev is included in the "Rosfinmonitoring list" - a list of organizations and persons involved in terrorist or extremist activities.
However, in March 2013 the law prescribing the blocking of accounts of persons and organizations included in the list Rosfinmonitoring, has not yet been adopted, so the bank had to monitor the state of Moseev's accounts, but did not have the right to block them arbitrarily.
Having found out through the court that the bank acted at his own discretion, Moseev managed to achieve a withdrawal of 50 thousand rubles. However, the activist filed a lawsuit against Sberbank with demanding compensation for damages of 100 thousand rubles.
On September 29, 2014, the Arkhangelsk Regional Court upheld the decision of the Oktyabrsky District Court.
Recall, from our point of view, Moseev's verdict was unlawful. In addition, we consider severe restriction on financial transactions for persons on the Rosfinmonitoring list unjustified measure.
