Fauzia Bayramova was convicted in Tatarstan

Tatar writer, head of the Milli Mejlis Tatarstan Fauziya Bayramova was convicted of inciting hatred in the case of publishing two texts on Facebook.

October 2, 2014 Naberezhnye Chelny City Court The Republic of Tatarstan recognized the Tatar writer, head of the Milli Majlis (national Parliament) of the Tatar people Fauzia Bayramova guilty under part 1 of Art. 282 of the Criminal Code (inciting hatred or enmity, as well as humiliation of human dignity) in the publication of texts on her personal page on the social network Facebook and sentenced her to a year conditional imprisonment.

Bayramova was convicted for publishing the article "Animals and Victims" (February 22 2014, i.e. even before Crimea became part of Russia) and Statements of the Milli Majlis on the events in Crimea and Ukraine (27 February 2014). The court agreed with the accusation that, by publishing these texts, Bayramova " committed actions aimed at inciting hatred and enmity, and also to humiliate the dignity of a person and a group of persons on the grounds of nationality .

We do not agree with the verdict of the court.

IN In both texts of Bayramova, from our point of view, there are no signs of Art. 282 of the Criminal Code. "Beasts and victims" is devoted to the persecution of peaceful Muslims in Tatarstan, committed, according to the author, with the knowledge of the leadership of the republic, and in a statement about the events in Crimea and in Ukraine, the solidarity of Tatar nationalists with the desire of the Crimean Tatar people to independence and disagreement with the policy of Russian authorities. The author does not allow dangerous appeals against any ethnic groups. In addition, we believe that extreme sharpness Ukrainian crisis inevitably provokes many to extreme statements, not characteristic of them at other times. In this situation, it is better not to use to criminal prosecution even for the most harsh statements, if they do not there is a crime in the most clear and unambiguous form. This consideration should be taken into account first of all when it comes to appeals addressed to citizens or authorities of another country. Otherwise law enforcement actions can only exacerbate the already high tensions in society.
