November 11, 2014 Moscow City Court, considering complaint against the verdict in the case of Maxim (Tesak) Martsinkevich, reclassified accusation with Part 2 of Art. 282 of the Criminal Code for part 1 of Art. 282 of the Criminal Code and commuted his punishment from 5 years imprisonment up to 2 years and 10 months.
On November 11, 2014, the Moscow City Court considered complaint against the verdict of the Kuntsevsky District Court in the case of Maksim (Tesak) Martsinkevich.
Recall that on August 15 this year, the court recognized the nationalist guilty under n. «a» h. 2 Article. 282 of the Criminal Code (inciting national hatred with threat of violence) and sentenced him to five years in prison strict regime.
A criminal case against M. Martsinkevich was initiated after he posted three videos on the social network. Two of them were posted on September 14, 2013 - under the titles "Throw out the chock! pre-election agitation!" and “Tesak about the film “Stalingrad” and the situation in Biryulyovo”, and one 28 September 2013 - "Cleaver about the movie Okolofutbol". December 13, 2013 Russian court issued a ruling on arrest in absentia Martsinkevich. On January 27, 2014, Tesak was extradited to Moscow from Havana.
The defendant's lawyers insisted either on a review of the case, or for the reclassification of charges. The appellate instance of the Moscow City Court agreed with arguments of the defense and reclassified the case for hours. 1 Article. 282 of the Criminal Code (excitation national hatred), thus excluding the aggravating circumstance - the threat of violence. Moreover, in connection with the reclassification of the case was reduced with the sentence itself. Instead of 5 years M. Martsinkevich will spend 2 years and 10 months in the colony.
