Since the emergence of the Federal List of Extremist Literature, cases of sanctions against library employees have become regular. Even in cases where claims against librarians are formally justified by anti-extremist legislation, we often do not consider them legitimate, since this legislation is in conflict with the law “On Librarianship.” Read more about this here .
In addition, anti-extremist sanctions against libraries for not having a list of extremist materials, in our opinion, look like an imitation of activity designed to artificially inflate the relevant statistics.
We combined these cases into a single list, the first part of which covers the period from July 2008 to June 2011, the second part - from July 2011 to June 2012, and the third part - from July 2012 to the end of 2014. The continuation of the list is in front of you.
On December 30, 2015, the prosecutor's office of the Novosibirsk region reported that during the year the prosecutor's office of the Pervomaisky district of Novosibirsk conducted inspections in 10 schools and two vocational education institutions and found that in school libraries (apparently in all) " employees do not have information about banned books and other printed materials of an extremist nature, do not take measures to obtain a list of prohibited extremist materials, do not compare existing and incoming literature in library collections with the regularly updated federal list of extremist materials ." Requests were made to school directors to eliminate violations of the law, and employees were brought to disciplinary liability.
On December 22, 2015, the prosecutor's office of the Chelyabinsk region reported that the Kartaly city prosecutor's office lodged protests against the director of the Central Library System of the Kartaly region and the director of school No. 17 in the city of Kartaly, and also warned them about the inadmissibility of violating the law on protecting children from inappropriate information. The instructions issued by the head of the Central Library for working with the Federal List of Extremist Materials and the order of the school director stipulated that libraries could issue books included in the list upon written request from the reader. The prosecutor's office considered that this procedure violates the law. The leaders satisfied the protests of the prosecutor's office and changed the documents.
On December 18, 2015, the prosecutor's office of Tatarstan reported that the prosecutor's office of the Alekseevsky district submitted proposals to eliminate violations of anti-extremist legislation to the heads of Sredentiganskaya and Bolshetiganskaya secondary schools and the Bolshetiganskaya rural library. The reason was that school and rural libraries did not regularly and fully check their collections against the Federal List of Extremist Materials.
On December 8, 2015, the prosecutor's office of the Leningrad region reported that the Kingisepp city prosecutor's office submitted proposals to eliminate violations of the legislation on countering extremism to the director of the Ivangorod Humanitarian and Technical Institute (a branch of the St. Petersburg State University of Aerospace Instrumentation) and the head of the administration of the Bolshelutsk rural settlement. The reason was that university and rural libraries did not check with the Federal List of Extremist Materials.
On December 3, 2015, the prosecutor's office of the Belgorod region reported that the prosecutor's office of the Ivnyansky district sent 12 statements of claim to the court to force the heads of educational institutions to bring the provisions on libraries into line with the requirements of federal legislation. As the prosecutor's office points out, they do not contain rules aimed at preventing the spread of extremist and terrorist materials, in particular, when forming library collections.
On November 27, 2015, the prosecutor's office of the Tver region reported that prosecutors in various districts of Tver and the region, as a result of conducting an inspection in educational institutions to ensure compliance with the requirements of the legislation on countering terrorism and extremism, made a number of recommendations to eliminate violations of the law to the school administration. Among other things, the reason was that the school library of secondary school No. 1 of the Kashinsky district did not have a recent version of the Federal List of Extremist Materials to compare the library fund and new acquisitions with it, and in the libraries of the Brusovskaya, Moldinskaya and Ryadskaya schools of the Udomelsky district there was no list at all.
On November 25, 2015, it became known that the prosecutor’s office of the Zavitinsky district of the Amur region submitted a proposal to the director of school No. 1 of Zavitinsk to eliminate violations of the law, including countering extremism. The audit found that the school library had not updated the Federal List of Extremist Materials and had not identified an official who was required to reconcile the fund and receipts with the list. The head of the library was brought to disciplinary liability in the form of a reprimand.
On November 13, 2015, the prosecutor's office of the Gribanovsky district of the Voronezh region announced warnings against violating the legislation on countering extremism to librarians of five district schools. The reason was that school libraries did not have the latest version of the Federal List of Extremist Materials, and the contents of the collections and new receipts were checked against the 2013 version.
On November 9, 2015, it became known about 17 warnings about the inadmissibility of violating the law and the same number of submissions made by the prosecutor's office of the Leninsky district of Makhachkala to school principals in the district. The reason for the sanctions was that the regulations on the school libraries of these institutions did not contain a direct ban on the distribution of extremist literature, the procedure for checking the library collection and incoming literature with the Federal lists of extremist materials, and the verifications themselves were not carried out.
On November 5, 2015, it became known about 9 submissions made by the Mikhailovsky District Prosecutor's Office of the Ryazan Region to the directors of educational institutions in the region. The reason for the sanctions was that the regulations on the libraries of these institutions did not contain a direct ban on the distribution of extremist literature and did not establish the obligation to reconcile the library collections and incoming literature with the Federal List of Extremist Materials.
On October 26, 2015, it became known about protests against the provisions on libraries and warnings about the inadmissibility of violating the law, submitted to the rectors of four Moscow universities: Russian Economic University. G.V. Plekhanov, State Academic University of Humanities, Moscow State University of Design and Technology, National Research Technological University "MISiS" Zamoskvoretsky Interdistrict Prosecutor's Office of Moscow. The prosecutor's office's claims were caused by the fact that the regulations on libraries did not contain a direct ban on the distribution of extremist literature and did not determine the procedure for reconciling funds and incoming literature with the Federal List of Extremist Materials. Based on the results of consideration of the protests, the provisions on libraries were brought into compliance with the law.
On October 13, 2015, it became known about the submissions made by the Prosecutor's Office of the Chechen Republic to the heads of pre-trial detention center No. 2 of the Federal Penitentiary Service of Russia for the Chechen Republic. The reason for the sanctions was, in particular, that the library of the pre-trial detention center did not check the literature with the Federal List of Extremist Materials.
On October 9, 2015, it became known that the prosecutor's office of the ZATO Snezhinsk, Chelyabinsk region, submitted proposals to eliminate violations of the legislation on countering extremist activities by the head of several educational organizations and the head of the city education department. The reason for the sanctions was that collection reconciliations in school libraries were not carried out in a timely manner, and copies of the Federal List of Extremist Materials were not updated.
On September 30, 2015, it became known about a lawsuit regarding the obligation to ensure control over the regularity of changes to the Federal List of Extremist Materials, filed by the prosecutor's office of the city of Udachny (Republic of Sakha (Yakutia) to the management of city vocational school No. 28. The reason for the lawsuit was that in the school library there was an outdated version of the Federal List of Extremist Materials. The proceedings in the case were terminated due to the voluntary compliance with the demands of the prosecutor's office.
On September 11, 2015, the prosecutor's office of the Tula region reported that the prosecutor's office of the Volovsky district had submitted proposals to eliminate violations of the legislation on countering extremism to the directors of nine local schools. The reason was that in the libraries of Baskakovskaya Secondary School, Volovskaya Secondary School No. 1, Volovskaya Secondary School No. 2, Lutovskaya Secondary School, Boryatinskaya Secondary School, Verkhupskaya Secondary School, Nepryadvenskaya Secondary School, Dvorikovskaya Secondary School and Station Secondary School there was no full version of the Federal List of Extremist Materials for checking library collections with it and new arrivals.
On September 10, 2015, it became known about a proposal made to the management of the Coastal School of the Novooskolsky District of the Belgorod Region. The violation was seen in the fact that local acts of the institution did not provide for the procedure for reconciling the library collection with the Federal List of Extremist Materials, and such reconciliations themselves were not carried out.
On September 7, 2015, the prosecutor's office of the Altai Republic reported that the prosecutor's office of the Turochaksky district submitted a proposal to eliminate violations of the legislation on countering extremist activities to the administration of the Tondoshen secondary school. The reason for the penalty was that school employees “do not have information about 169 extremist materials .”
On August 27, 2015, it became known that the prosecutor's office of the Turochaksky district of the Altai Republic submitted proposals to eliminate violations of the law to the heads of the library named after. V.M. Bashunov and the children's library of the House of Creativity and Leisure of the Turochak district. The reason for the sanctions was that in the library. V.M. Bashunov did not have an updated copy of the Federal List of Extremist Materials (which did not contain information about “ 26 extremist materials ”), and the children’s library of the House of Creativity and Leisure did not have any copy of the List.
On August 27, 2015, the prosecutor's office of the Pervomaisky district of the Tomsk region reported on the submissions made to the directors of five schools in the district. The reason for the sanctions was that for the last two years, school libraries have not carried out verification of collections and incoming literature with the Federal List of Extremist Materials.
On August 18, 2015, it became known about a number of submissions (the exact number is unknown) made to the heads of educational institutions of the Teplo-Ogarevsky district of the Tula region by the prosecutor's office of the Teplo-Ogarevsky district. The reason for the sanctions was, among other things, the absence of a Federal List of Extremist Materials in these institutions or the presence of an outdated version of it.
On July 24, 2015, the prosecutor's office of the Ivanovo region reported that the prosecutor's office of the Zavolzhsky district had submitted recommendations to eliminate violations of the legislation on countering extremism to the heads of 8 educational institutions; they were considered by the Zavolzhsky Court and satisfied in full. The reason was that the libraries of educational institutions did not have the latest version of the Federal List of Extremist Materials.
On July 23, 2015, the Vladimir prosecutor's office reported nine submissions made to the directors of city schools. The reason for the sanctions was that school libraries did not check the collections and incoming literature with the Federal List of Extremist Materials.
On July 22, 2015, it became known about the proposal made by the prosecutor's office of the city of Gubkinsky (Yamalo-Nenets Autonomous Okrug) to the management of school No. 4 of Gubkinsky. The reason for the sanction was the absence in the school library of an updated copy of the Federal List of Extremist Materials.
On July 9, 2015, it became known about the submission that the North-Western Transport Prosecutor's Office made to the management of the St. Petersburg University of Civil Aviation. The reason for the sanction was that the university library did not have an updated version of the Federal List of Extremist Materials, and the library collections were not checked against the List.
On June 30, 2015, the Serpukhov City Prosecutor's Office of the Moscow Region reported on a proposal made to the head of the pre-trial detention center-3 of the Federal Penitentiary Service for the Moscow Region. The reason for the sanctions was that the library of the pre-trial detention center did not check the collections with the Federal List of Extremist Materials. During the inspection, a book included in the List was found in the library, after which it was confiscated and destroyed. Let us remind you that the legislation on library science does not provide for the possibility of removing literature from collections. Law enforcement agencies had the right to demand only the exclusion of public access to prohibited materials.
On June 26, 2015, it became known that the prosecutor's office of Yoshkar-Ola (Mari-El) made a representation to the director of the city secondary school named after V.S. Arkhipova. The reason for the presentation was that books were discovered in the school library, “ the content of which incites hatred and enmity .” It is unknown whether these publications were in the public domain and whether they were included in the Federal List of Extremist Materials, but we assume that librarians are guided by the legislation on library science.
On June 23, 2015, it became known about the submission made by the Vyshnevolotsk Interdistrict Prosecutor's Office of the Tver Region to the director of the Vyshnevolotsk College. The reason for the sanction was, in particular, that the college library did not check its collections against the Federal List of Extremist Materials.
On June 15, 2015, it became known about protests brought by the prosecutor's office of the Pravoberezhny district of Magnitogorsk against the regulations on the libraries of the city's pedagogical and polytechnic colleges. The reason for the sanctions was that the provisions did not contain a ban on the distribution and storage for the purpose of disseminating extremist literature.
On June 9, 2015, it became known about 64 proposals to eliminate violations of the law submitted to the heads of educational institutions in Derbent and the Derbent region of the Republic of Dagestan. All of them were caused by the fact that the libraries of these institutions do not have copies of the Federal List of Extremist Materials and reconciliations with the List of holdings and incoming literature are not carried out.
On June 5, 2015, the prosecutor's office of Mirny (Republic of Sakha - Yakutia) reported on the submissions made to the directors of two schools in the Mirny district. The reason for the sanctions was that school libraries did not check the collections and incoming literature with the Federal List of Extremist Materials.
On June 3, 2015, the prosecutor's office of the Trans-Baikal Territory reported that the prosecutor's office of the Uletovsky district issued a warning about the inadmissibility of violating the legislation on countering extremism to the teacher-librarian of the Drovyaninskaya secondary school, who, when conducting checks of the school library fund and new acquisitions for the presence of extremist materials, did not use the latter version of the Federal List of Extremist Materials.
On June 3, 2015, the prosecutor's office of the Kaluga region reported that the prosecutor's office of the Sukhinichi district made nine representations to the heads of regional educational institutions and the head of the education department of the district administration, 17 officials were brought to disciplinary liability. The reason was, in particular, that there was no Federal List of Extremist Materials in school libraries.
On June 2, 2015, it became known that the prosecutor's office of the Polessky district of the Kaliningrad region revealed in the regulations on the school library that there was no ban on the distribution and storage of extremist literature. The prosecutor's response measures have not been specified.
On June 1, 2015, it became known about the presentation made by the transport prosecutor's office of the Krasnodar region to the management of the Yeisk Marine Fisheries College, a branch of the Astrakhan State Technical University. The reason for the sanction was, in particular, that the library of the educational institution did not check the funds and incoming materials with the Federal List of Extremist Materials.
On May 27, 2015, the prosecutor's office of the Altai Republic reported that the prosecutor's office of the Chemal district was made warnings to the heads of six educational institutions of the district. On April 3, 2015, the Vsevolozhsk city prosecutor's office of the Leningrad Region announced the ideas of school managers (the number is not specified) and two protests on local regulatory acts regulating work with the library fund. On March 25, 2015, the Prosecutor's Office of the Magadan Region reported that the prosecutor's office of the Omsukchansky district was submitted to the director of a professional school No. 11. The reason was, in particular, the fact that the school library did not contain the current version of the federal list of extremist materials.
On March 25, 2015, the Prosecutor's Office of the Kostroma region said that the prosecutor's office of the Makaryevsky district made four submission to the leadership of local educational institutions. Among other things, the reason was that in libraries of educational institutions there were no reconciliation of funds with the federal list of extremist materials.
On March 19, 2015, the Prosecutor's Office of the Republic of Udmurtia said that the prosecutor's office of the Oktyabrskaya district prosecutor of Izhevsk was introduced that it was necessary to eliminate violations of the legislation on counteracting extremism to the rector of the Izhevsk State Technical University named after M.T. Kalashnikova, Director of the Scientific Library and Vice-Rector of the University of Security and Regime, were brought to disciplinary liability, and Deputy Director of the Scientific Library for Organizational and Methodological was fined 2000 rubles under Art. 20.29 Code of Administrative Offenses (mass distribution of extremist materials included in the published federal list of extremist materials, as well as their storage for mass distribution). On March 13, 2015, the prosecutor's office of the Muchkap district of the Tambov region announced the presentation made by the director of the Central Library of the Muchkapsky district. The reason for the presentation was, in particular, an outdated copy of the federal list of extremist materials at the time of verification, which was in the library.
On February 28, 2015, from a review message from the prosecutor's office of the Udmurt Republic on the events of 2014, it became known that the director of the library of the Udmurt State University in 2014 was brought to administrative responsibility under Art. 20.29 Code of Administrative Offenses (distribution of extremist materials), since the library was freely available books recognized as extremist.
On February 25, 2015, the Gryazinsky Interdistrict Prosecutor's Office of the Lipetsk Region announced the ideas made by the heads of 10 schools of the Gryazinsky district. On February 20, 2015, the prosecutor's office of the Bondar district of the Tambov region announced the presentation made by the head of the Bondar inter -settlement library. On February 5, 2015, the Prosecutor's Office of the Leningrad Region reported that the prosecutor's office of the Lomonosovsky district made nine protests on the charters of school libraries and ideas about eliminating violations of legislation against the directors of the district schools. On January 28, 2015, it became known about the presentation that the prosecutor's office of the Turochak district of the Altai Republic contributed to the director of the Dmitrievsky school of the Turochak district. The reason for the sanction was that the copy of the federal list of extremist materials in the school library was outdated: it differed from the 18 points acting at the time of verification.
On January 22, 2015, it became known about claims filed in court to the prosecutor's office of the Nurbin district of the Republic of Sakha (Yakutia). The reason for the claims was that in the libraries of the Oski school and the Nyurba school No. 3 there were no reconciliation of library funds and incoming literature with the federal list of extremist materials.
