Daria Polyudova has been charged

On January 28, 2015, it became known that the investigation into the case of the march for the federalization of the Kuban against Daria Polyudova and the transfer of the case to court.

The Rot-Front activist is charged under Part 2 of Art. 280.1 of the Criminal Code (public calls for the implementation of actions aimed at violating territorial integrity of the Russian Federation, committed using the Internet) and hch. 1 and 2 Art. 280 of the Criminal Code (public calls for the implementation of extremist activities).

Recall that Polyudova, arrested in early September 2014, anarchist Vyacheslav Martynov and psychologist Petr Lyubchenkov became defendants in a criminal case for trying to organize a march in Krasnodar for the federalization of the Kuban. Lyubchenkov and Martynov fled to Ukraine. On February 25, 2015, Polyudova was released from the SIZO on bail.

From our point of view, the criminal prosecution of Polyudova illegally. The organizers of the marches for federalization did not allow themselves separatist appeals, it was only about granting autonomous rights to individual territories within the Russian Federation, so their actions are not subject to again introduced Art. 280.1 of the Criminal Code (public calls for action, aimed at violating the territorial integrity of the Russian Federation). Recall also that we do not consider it legitimate to attempt to prohibit (in particular, by introducing Art. 280.1) public discussion on the topic of the rights of individual territories, the right to self-determination and even separatist appeals. Prohibitions may be justified only when it comes to calls for violent action with separatist goals.

We also note that the authorities of the Krasnodar Territory are widely practice criminal prosecution as a method of combating opposition and environmental activists.

On March 12, 2015, in an interview with Kasparov.Ru, the activist described what she was accused of: “I posted on my VKontakte page a photo from a picket with a poster “Not a war with Ukraine, but a revolution in Russia” (part 2 of article 280 of the Criminal Code of the Russian Federation), reposted a playful entry that ethnic Kubans want to go to Ukraine (part 2 of article 280.1 of the Criminal Code of the Russian Federation) and stated that Putin is to blame for all terrorist attacks and disasters (part 2 of article 280 of the Criminal Code of the Russian Federation) " . Thus, Polyudova is not accused of actually organizing a march for the federalization of the Kuban, although it was she who obviously served as the reason for the persecution. So far, we do not have detailed information about the content of Polyudova's publications, however, judging by preliminary information, they did not contain dangerous appeals deserving criminal prosecution.
