On April 21, 2015, the Moscow Regional Court rendered a verdict in the case of the neo-Nazi group “Combat Organization of Russian Nationalists” (BORN).
Let us remind you that Vyacheslav Isaev, Maxim Baklagin, Mikhail Volkov and Yuri Tikhomirov were involved in the case.
M. Baklagin was accused under paragraphs. a, g, h, l, part 2 of article 105 of the Criminal Code (murder of two or more people motivated by national hatred), art. 317 of the Criminal Code (attack on the life of a law enforcement officer), Part 3 of Article 222 of the Criminal Code (illegal trafficking in weapons); Part 2 Art. 209 of the Criminal Code (banditry); Art. 295 of the Criminal Code (attack on the life of a person administering justice).
M. Volkov was accused under paragraphs. a, g, h, l part 2 tbsp. 105 Criminal Code, Part 3, Art. 222 Criminal Code, Part 2, Art. 209, part 2 art. 282.1 CC.
Yu. Tikhomirov was accused under Part 3 of Art. 222 Criminal Code, part 2 art. 209 of the Criminal Code, Part 2 of Article 282.1 (participation in an extremist community) of the Criminal Code.
V. Isaev was accused under paragraphs. a, g, h, l part 2 tbsp. 105 Criminal Code, Art. 317 Criminal Code, Part 3, Art. 33 art. 222 Criminal Code, Art. 295 Criminal Code, Part 2, Art. 209 of the Criminal Code.
During the trial, the charges against Baklagin and Isaev under Part 2 of Art. 282.1 CC.
Baklagin and Isaev were sentenced to life imprisonment, Volkov to 24 years in prison. Volkov will serve part of the sentence—the first 10 years—in prison, and the rest in a maximum security colony. Baklagin and Isaev will serve their sentences in a special regime colony.
During the debate, the state prosecution also demanded that Volkov, Baklagin and Isaev be fined in amounts ranging from 800 to 900 thousand rubles. The court did not do this.
Yuri Tikhomirov was acquitted by the jury - they considered his participation in the BORN gang and weapons trafficking unproven. In 2012, he was convicted of the murder of anti-fascist Ilya Japaridze.
Volkov, Isaev and Baklagin were found guilty of participating in the BORN gang and extremist community, as well as illegal weapons trafficking.
Volkov was found guilty of murdering anti-fascist Fyodor Filatov and member of the Black Hawks group Rasul Khalilov. The board found Baklagin and Isaev guilty of the murders of anti-fascists Ilya Japaridze and Ivan Khutorsky, world Thai boxing champion Muslim Abdullaev, taxi driver Sos Khachikyan and the attempted murder of athlete Ramazan Nurichuev.
The jury decided that with the participation of Baklagin and Isaev, the murder of judge Eduard Chuvashov was committed; Isaev was also found guilty of the attempt on the life of district police officer Gagik Benyaminyan.
According to the investigation, at least seven people took part in the activities of BORN. Nikita Tikhonov (sentenced to life imprisonment) and his accomplice Evgenia Khasis (sentenced to 18 years in prison) were convicted of the murder of lawyer Stanislav Markelov and journalist Anastasia Baburova. At the end of September 2014, the court sentenced Tikhonov to another 18 years for creating BORN, illegal weapons trafficking and involvement in several more murders. Tikhonov fully admitted his guilt and confessed against the rest of the gang. Khasis was not charged with participating in BORN; in this case she is a witness for the prosecution. Tikhonov and Khasis decided to give thanks in February 2012. Tikhonov wrote a confession in the Polar Owl colony in the village of Kharp in the Yamalo-Nenets Autonomous Okrug.
Also involved in the BORN case is the former leader of the far-right organization “Russian Image” Ilya Goryachev, extradited from Serbia, whose case was brought to court.
The organization also included neo-Nazi Alexei Korshunov, who died in October 2011 in Ukraine from a grenade explosion, and Alexander Parinov, hiding in Ukraine.
