Boris Stomakhin complained to the ECHR

In June 2015, the European Court of Human Rights (ECHR) registered a complaint by Boris Stomakhin, editor of the Radical Politics bulletin, against the verdict in the second criminal case.

The European Court of Human Rights (ECHR) has registered a complaint by Boris Stomakhin, editor of the Radical Politics bulletin, Boris Stomakhin, against the verdict of the Butyrsky Court in 2014. The complaint was filed against the verdict of the Butyrsky Court of Moscow dated April 22, 2014 and decision of the Moscow City Court dated July 15, 2014. Stomakhin believes that it was his right to freedom of expression has been violated (Article 10 of the European conventions for the protection of human rights and fundamental freedoms). Recall that the Butyrsky District Court of Moscow found Stomakhin guilty under Part 1 of Art. 280 of the Criminal Code (public calls for extremism), Part 1 of Art. 282 of the Criminal Code (inciting national and religious hatred), part 1 of Art. 205.2 of the Criminal Code (justification of terrorism) and art. 30 of the Criminal Code and part 2 Art. 205.2 of the Criminal Code (preparation for the public justification of terrorism with using the media) and sentenced to 6.5 years in prison. The reason for the prosecution was the publication of several articles on the Internet and “Radical Politics” (“Preventing a New Holocaust”, “In Memory of Martyrs”, “Second Civil”, "Time of Heroes" and several others).

The sentence appealed by Stomakhin to Strasbourg is the second of three delivered to him by the Moscow courts. In 2006, the Butyrsky District Court of Moscow sentenced him to 5 years in prison under 1 Art. 282 of the Criminal Code and part 2 of Art. 280 of the Criminal Code. In November 2011, Stomakhin was released from the colony, and a year and a half later he was detained. The reason for the initiation of the second criminal case was the texts “Do not allow a new Holocaust”, “Untermenshen” and “In memory of martyrs”. For their publication, on April 22, 2014, the Butyrsky Court found him guilty under Part 1 of Article 205.2 of the Criminal Code and sentenced him to 6.5 years in prison. Stomakhin was sentenced for the third time in April 2015 by the Moscow District Military Court for publishing the text “Or blow up a couple of railway stations here!” after the terrorist attacks in Volgograd. The defendant allegedly wrote the text in a notebook and handed it over from the pre-trial detention center for posting on Stomakhin's blog on the lj.rossia.org portal. April 20, 2015, the court sentenced On Article 205.2 of the Criminal Code to 7 years in a strict regime colony.
