At the end of June 2015, in the Tver region, a case was submitted to the court about public calls for extremism made on the Old New Year by a visitor to the village cafe "Traktir".
On June 29, 2015, it became known that the investigation into Part 1 Art. 280 of the Criminal Code (public calls for extremist activity) in relation to the 38-year-old resident of the Maksatikhinsky district of the Tver region. The case was transferred to Maksatikhinsky district court for a hearing on the merits.
According to the investigation conducted by the FSB Directorate for the Tver Region, on the night of January 14-15, 2015 the accused, being in the cafe "Traktir" in the village of Rivitsky Maksatikhinsky district, " made public calls for an extremist activity ."
The content of these appeals is unknown, however, in our opinion, this criminal case was unlawfully initiated, because no matter how rude and inflammatory appeals were not made publicly. The accused spoke in cafe and was most likely addressed to a small group of visitors. In addition, the date events leads to suspicion that his statements cannot be qualified as intentional acts described in the relevant articles of the Criminal Code.
