Daria Polyudova's case has been sent to court

In Krasnodar, the case of calls for the overthrow of the government and separatism went to court.

Recall that Polyudova is charged under Part 2 of Art. 280.1 CC (public calls for the implementation of actions aimed at violating the territorial the integrity of the Russian Federation, committed using the Internet) and hh. 1 and 2 Art. 280 Criminal Code (public calls for extremist activities, including those committed with using the Internet).

Polyudova published on her page in the social network "VKontakte" indictment, which I was able to read on 31 July. We believe, that the charge under Art. 280.1 of the Criminal Code was unlawfully brought against Polyudova. Record about that ethnic Ukrainians in the Kuban are being persecuted, asking for Ukraine and the international community to stand up for them and demand accession to Ukraine, did not contain calls for violence and did not pose a danger. In general, we have a negative attitude towards the introduction of Article 280.1 into the Criminal Code, since, from our point of view, view, only calls for violent separatism deserve persecution.

The accusation of Polyudova under Part 1 of Art. 280 CC for poster "Not a war with Ukraine, but a revolution in Russia" we also tend to consider illegal: the term "revolution" allows for a broad interpretation and may imply any drastic changes, so treat its use as a direct the call for forceful action seems to us wrong.

Publication of the indictment conclusion gave us the opportunity to familiarize ourselves with the publication on the social network, which served as the reason for bringing charges against Polyudova on Part 2 Art. 280 of the Criminal Code. This text really contained a call to go to the square and to overthrow the regime on the model of the Maidan, which can be regarded as an inducement to illegal actions. However, it should be borne in mind that the degree the public danger of such one-time statements (and they abound in our days the Russian sector of the Internet), not supported by any specific plans and even more so by actions, is small, and it is unlikely that criminal prosecution is in such cases by proportional measure.
