The videos of the group “Ensemble of Christ the Savior and the Mother of Cheese Earth” are recognized as extremist.

The Federal List of Extremist Materials includes three videos with songs by the Ensemble of Christ the Savior and Mother Earth Cheese. In our opinion, this ban is highly controversial.

August 26, 2015 in the next update of the Federal list of extremist materials was included section 3011, which prohibits three clip of the group "The Ensemble of Christ the Savior and Mother Earth Cheese".

Thus, the List now includes five songs of this groups: " Video files: "The Ensemble of Christ the Savior and Mother Earth Cheese - You can't command your heart" (7ad051a028.240), "The Ensemble of Christ the Savior and Mother earth cheese - crucify all these deputies "(8eb126010f.240)," Ensemble Christ the Savior and Mother Earth Cheese - Merchants of God "(5275f78991.240) (verdict of the Ordzhonikidzevsky District Court of Yekaterinburg of the Sverdlovsk region dated 06/26/2015) ", as well as the video "Synagogue", which was previously included in the list by decision of the Central District Court of Kemerovo dated May 30, 2014 under p. 2443 and the audio recording "Breaking the Crescent" (p. 2654, decision of the Pskov City Court of December 22, 2014).

Punk band "Ensemble of Christ the Savior and Mother cheese land" defines his own work as "radical political hardcore." In one of the materials about the group, you can read the following: "Participants promote, in their own words, chauvinism and obscurantism, as well as the total dictatorship of the law, Nazism and Orthodox Sharia. This is done with the most serious mine and in the most grotesque way. At first glance, it seems that the purpose of this image is to insult the feelings of believers, extremism and just hypocrisy, but in reality it is a mockery of the abuse of national values ​​- in other words, fanatical Orthodoxy, xenophobia, a slave mentality and other possible vices of the average Russian man in the street. The participants themselves, among other things, declare that their work is intended for people with high intelligence " . In July 2013, the concerts of the group" Ensemble of Christ the Savior and Mother cheese land" were canceled in a number of cities at the request of the Union of Orthodox Brotherhoods of the Russian Orthodox Church as "ugly and blasphemous acts."

The AHSiMSZ song, where Hitler is sung in a joking manner ("You can't order your heart"), a song about parliamentarians mired in vices ("Crucify all these deputies"), about the money-grubbing of the Russian Orthodox Church ("Merchants of God"), and also - earlier - songs about Jews and people from the Caucasus as internal enemies to blame for everything, who should be dealt with ("Synagogue", "Breaking the Crescent Moon").

The legality of the ban on the band's songs is difficult to assess, as it obviously represents a complex legal case.

The texts of AHSiMSZ clearly express hostility or disrespect for several groups of citizens (we note, however, that the law prohibits humiliating any groups of people, in particular, are not forbidden to speak offensively about groups of politicians or about religious organizations as such), there are direct calls for reprisals against representatives of some of them. However, these texts do have a grotesque character, and the authors verbally recommend that they be perceived as satirical. It should be noted that the group is very popular in the ultra-right environment. In this case, it is difficult to interpret the motivation of artists in terms of law enforcement. It seems to us that satire and sincere statements are mixed in the work of AHSiMSZ, which is generally characteristic of punk rock. In addition, the authors are cunning when they say that they are guided by those for whom their work is an intellectual game, in fact, they are ready to flirt with an audience of all sorts. For example, the song "Breaking the Crescent" does not sound satirical in tone and should be quite positively perceived by ultra-right youth.

However, since this is not a criminal charge against the members of the group, but a ban on songs, the intentions of the authors are not so significant: the content and potential danger of the lyrics are important. And here too there is no clarity. Obviously, even parodic appeals can find an appreciative audience ready to put them into practice. But many other statements that do not fall under the law can also carry a potential danger. The law, in principle, is not capable of prohibiting all statements that may have negative consequences; it can only be directed against statements of a certain kind.

Apparently, within the framework of the current legislation, the legitimacy this prohibition is simply impossible to unequivocally assess. Which once again brings to mind that statutory prohibitions should be narrowed down and defined more precisely, and from such a dubious method as the prohibition of certain materials (whether books, songs or something else) outside of the activities of specific people related to them, you should simply refuse.

We also see a vivid example of how artistic creativity (whatever you think of it from an aesthetic point of view) turns out to be too difficult to interpret within the competence of law enforcement agencies. This does not mean at all that the law cannot be violated by means of art, but it This means that the degree of uncertainty in such cases is much higher.
