The Ministry of Telecom and Mass Communications plans to introduce a new article into the Code of Administrative Offenses.
October 27, 2015 on the United portal for placement of draft regulatory acts was published for public comment developed Ministry of Telecom and Mass Communications bill "On amendments to the Code of the Russian Federation of Administrative offenses (in terms of establishing carriers' liability for failure to comply with the obligation to restrict access to sites on the Internet).
Ministry proposes to introduce an article into the Code of Administrative Offenses 13.32 "Failure by the telecom operator, providing services for the provision access to information and telecommunications the Internet, responsibilities for restricting access to a site on the network "Internet" whose network address entered in the Unified Register of Domain Names, web site page indexes "Internet" and network addresses that allow identify sites on the Internet, containing information, dissemination which is prohibited in the Russian Federation. According to part 1 of this article in if the operators do not block site entered in the Unified Register (according to rules, this must be done within days), developers bill propose to impose on them fine: for officials persons in the amount of 3 to 5 thousand rubles, for
persons engaged in business activities without legal education persons - from 10 thousand to 30 thousand rubles, for legal entities - from 50 to 100 thousand rubles.
By part 2 of the new articles are invited fine providers and (or) operators communications for non-renewal of access to site within 24 hours after receiving notification Roskomnadzor about exclusion of a domain name, pointer site page and network address (network addresses) from the unified register: for
individuals fine should be from 200 before 500 thousand rubles; officials in the amount of 3 up to 5 thousand rubles; on persons carrying out entrepreneurial activity without formation of a legal entity, - from 10 up to 30 thousand rubles; for legal entities - from 50 before 100 thousand rubles.
Adoption such a bill is logical built into previous government measures to counter the spread prohibited content online: if there is an order to block such materials, so it must be provided punishment for failure to do so requirements. Recall that some mechanisms for replenishing the Unified Register cause us significant complaints. In addition, I would like to point out that days - such a period in which they can meet only the largest providers and operators smaller just don't are able to track so often changes in the Unified Register and accept necessary measures.
