The SOVA Center got acquainted with the draft of the new Code of Administrative Offenses submitted for public discussion.
At the end of October 2015 on public comment has been made draft of a new Code of Administrative offenses compiled by a group deputies from United Russia, he published on the portals of several news agencies.
We got acquainted with the project and found the following changes in articles related to the fight against extremism.
According to Art. 5.26 (in the new version Art. 7.4) Administrative Code, punishing for violation laws on freedom of conscience, freedom of religion and religious associations, fines for individuals persons remain the same, for officials - are doubled.
According to Art. 6.17 (new version 10.5) Administrative Code on the protection of children from information, harmful to their health and/or development, increase several times fines for all categories of persons, for legal entities they will reach three hundred thousand rubles.
According to Art. 13.15 (in the new version 22.15) Administrative Code on abuse of freedom media fines increase for officials and in some parts — lower levels of fines for legal entities persons. In addition, the article is planned make part 7 - " distribution information that offends the memory of participants, veterans and victims of the Great Patriotic War of 1941-1945, including including committed with the use of funds mass media and (or) information and telecommunication networks (including the "Internet") "; the penalty for it should range from two thousand to two thousand five hundred rubles for citizens, from four thousand to five thousand rubles for officials persons, from forty thousand to fifty thousand rubles for legal entities. in many times only the fine increases for disseminating information about affected by unlawful acts of an adult, for legal entities it will be from 1 to 5 million rubles.
Art. 20.3 (in the new version of Art. 37.4) Administrative Code on propaganda and demonstration Nazi or extremist symbols remains virtually unchanged only slightly increased fines, levied on it from officials.
According to Art. 20.29 (at new version 37.24) of the Code of Administrative Offenses on the distribution of extremist materials for officials persons, the fines are slightly increased, but for legal entities - on the contrary sky-high a fine of one hundred thousand to one million decreases, it should amount to fifty to one hundred thousand rubles.
The recently proposed Ministry of Telecom and Mass Communications Art. 22.30 (non-performance by the telecom operator providing services for providing access to information and telecommunications network "Internet", the obligation to restrict access to the site on the network "Internet", the network address of which is included in the Unified Register of Domain names, pointers to pages of sites on the Internet and network addresses, allowing to identify sites on the Internet containing information, the dissemination of which is prohibited in the Russian Federation), the fine for it will be from five thousand to seven thousand rubles for officials, from ten thousand to thirty thousand rubles for individual entrepreneurs and from fifty to one hundred thousand rubles for legal entities.
On December 18, 2015, a draft of a new Code of Administrative Offenses was submitted to the State Duma.
